This company called me January of 2009 stating they were representing FIA Card Services. The first thing I was asked was "do you have an attorney?" Which I found a bit odd. They stated they would work with me to work out a fair settlement with FIA (Bank of America) but that they would need for me to agree to make a good faith amount agreed upon by me to begin the settlement process. At the time of the phone call I thought I was talking to Fredrick J Hanna as that is the person that called me initially and left a message on my phone.
During the call I asked who I was talking to and was told the person I was talking to was an assistant. I continued to negotiate on an agreeable amount which to begin with was 100.00 to be debited from my bank account monthly for five months until the good faith amount was satisfied. The assistant dismissed himself to discuss the amount with whomever he said it was his superior. He came back to the phone and then began to tell me his superior wanted me to submit the 500.00 all at once which I could not do then subsequently take 300.00 per month until July.
Each time he came back to the phone the amount went up, Finally after several back and forth attemps to settle this and in my defense I was trying to do the right thing, it was agreed upon that 100.00 would be debited on or about Febuary 9.2009 then another 400.00 be debited on the 20th of Febuary. The amount of 100.00 was not debited until the 17th of Feb. and as of today the 27th of Feb. This is putting me in a bind financially as other creditors are debiting my checking account and soon I will not have enough to cover the 400.00. Also after some research I am finding out I did not have to agree to this arrangement. How in the world do I stop these vultures from taking money out of my checking account?

The Georgia Supreme Court says Hanna is a "law firm," so you have to submit a bar complaint vs. them (and not a consumer complaint with the state OCA or federal FCC -- but fine if you do that too anyway). Can somebody recommend me a good Consumer Attorney

I had been served paper by this people recently and I am trying to get the name of the consumer Attorney who can really face this fraud people. what would be best resource for finding one. Looking all the reports I am so shocked that how come all these people can be in business for this long. Where are the lawmakers in Georgia? I had a better expectation from Sunny Purdue. Dont they have kind of accountablity? How they forget all their responsibility after we vote to win their election. Dont they have any shame? I am so hurt to find out how they are ruining so many peoples life. Are we all cowards!!

First of all. Never acknowledge or admit to any Hanna account whether you know you owe it or not. The burden of proof is on them, not Joe Debtor. Secondly, STAY OFF THE PHONE! Acknowledging the debt verbally or in writing makes you a sitting duck when they sue you.
When you get their first dunning letter you have 30 days to dispute it under the FDCPA. ALWAYS demand validation. Make it short and sweet and do not threaten or draw unnecessary attention. I'm not an attorney and this isn't legal advice. Just someone who has successfully defeated two law firms suing me pro se in court and have won numerous "out of court settlements" entraping 3rd party agencies into FDCPA violations. For the posters stirring the pot telling me I'm "Practicing Law without a license." This is free advice, I do not profit nor do I have a DBA specializing in Consumer Help.Readers can use it at their own risk. So stick to helping Birdie, if not, beat it! If you can afford an attorney, I recommend you hire one to help if Hanna sues you.

I am disputing the validity of your claim concerning the alleged ABC Credit account for x amount of dollars. I trust that this request for validation will be honored in full compliance with the FDCPA (section 809).

If and when Hanna successfully validates is the only way they can proceed with collecting. Otherwise, it's an FDCPA violation. Most FDCPA violations involve sections 805 to 811 so view the FDCPA site through the FTC for a thorough overview.
If Hanna issues you a summons. Deny everything in your answers.The burden of proof is on them, not you. This is general denial.
File a sworn denial letter along with your general denial answers to summons. Type it and have it notorized with the courthouse clerk before mailing a copy CMRRR to Hanna.This eliminates Hanna's sworn affidavit and forces them to produce a live witness on behalf of the creditor. This costs Hanna time and money and if it's an old debt that has changed hands, they may have trouble producing a live witness,if at all. The Sworn Denial is a graduated denial that states:
"I deny this is my debt and if it is my debt, I deny that it is still a valid debt and if it is a valid debt, I deny the amount of the creditor claim to be the correct amount."
Now you also need to motion for discovery before the answer to summons expires (usually 20-30 days from day you are served).
Production of Documents and Requests for Admissions. This forces the live witness to get authentic paperwork from the creditor. You need to demand things such as: original authentic contract, Itemized statements from inception to present. Bill of sales from debt buyer to debt buyer (assuming account has been sold and not with original creditor). Make sure they admit how much they purchased the alleged debt for (usually 2-30 cents on the dollar). Mention that this alleged debt for $10000 was purchased by Junk Debt Buyer XYZ (represented by Hanna attorney) for a hypothetical 5 cents on the dollar ($500), yet they are claiming that the alleged debt owed is $10000. Make sure you demand creditor witnesses for all creditors (original creditor and all debt buyers). Make sure they give detailed job descriptions, length of time on the job, prove they had direct knowledge of your account when they owned it, etc.These discovery motions need to follow your jurisdictions rules of civil procedure and be properly formatted. The clerk may give you the proper forms if you ask politely. Can't hurt to ask. Destroying the chain of custody of junk debt buyers represented by Hanna is possible. Nothing is 100% guaranteed but so far I'm two for two going pro se vs Law Firms like Hanna suing me on "alleged" accounts. Everything in writing is "ALLEGED" consumers.Good luck!

Close the account and reopen it with new #s if they call and ask for the new account# refuse to give it then hang up on them if they call again do not answer the phone you do not have to talk to them
