Ordered furniture on 4/30, told it would take 8 to 12 weeks and they would update mr every 2 weeks. Only heard from them a couple of times, told it was back ordered at manufacturer. Tried calling and emailing them beginning of August, no answer. Had placed 40% deposit of $844 on my credit card. Called credit card company after reading info on this website.

Small Claims Not much Help

We took FUSA to small claims this month. They did not show up! We were advised to list teh registered agent on teh claim as he was the attorney who filed for the articles of incorporation. The attorney has no liability, just a way to at least get the case to court. (Since FUSA has closed doors, you can not send your paperwork to an empty store- No one will be ther eto sign for it) Then, FUSA did not show up to court. We have the judgement in our favor.
Now, getting the money is the hard part. We had to wait ten days for FUSA to appeal the decision. They did not appeal. After the tenth day, you can apply for awrit of execution where the sherrif will go to Dean Warren and try to get your money.
It costs $25 to carry this out. We are still waiting to hear how that went. I am filing mail fraud charges with the US Post Office this week as was advised by another consumer. My sales rep actually sent me a copy of my money order and the envelope I sent it in!!!! after she received it. So, I have copies of correspondance through the mail!
I have since ordered more furniture through another store here in Charlotte. They were GREAT. The price was very fair and the service was excellant. My furniture came in four weeks.

I was able to get my depoist back from my credit card company. Thanks to this site or I would of never known what scum Furniture USA was. Filed a report with the FBI and Secret Service, havn't heard anything from them.

I talked with the FBI and they need to hear everyone's story so we can get these criminals. Even if your credit card credited you back, you were still a victim of fraud. They need to know! FBI in Greensboro is 336-855-7770 and the Secret Service is 336-547-4180.

I called the Bankruptcy Court in Winston-Salem (where they would have to file) and was told by the Clerk that although they have received a number of requests of this company (Furniture USA), they HAVE NOT FILED BANKRUPTCY. As far as getting your money back from your credit card company whether or not Furniture USA files bankruptcy in insignificant.
Credit card companies are more than understanding when it comes to matters like this. I placed my order back in October, 2003 and just last week my credit card company refunded my deposit. Include a copy of the BBB report on Furniture USA when requesting your refund. Hope you get your money back. Unfortunate for me, I was able to get my initial deposit of $3,290, but he $5,900 I paid by money order when the company called me to tell me my order was ready to be shipped, I will probably never see again!
If there is anyone out there that has either filed a claim in small claims court or is a part of a class action, please post. Thanks and good luck to all.
