After yet another email and after filing my report here, I got a reply stating they only ever got one email and offered to send me another pair.

They just arrived today and although they too are slightly damaged, this pair is better than the one first one they sent. At least the damage is on the lower leg not in the seat and not likely to get worse.

They did make this right as far as I am concerned. I would however, ask prior to ordering any "used" product from them if the product is "damaged" in any way.
