Where to began with this on 8/15/2016 while out of town, I had an accident on  I-30 that was the beginning  of the worst birthday ever, I  the car was deemed a total loss around about 25th thru the 26th some where in  that time a response of the car was going to be totalled out. I contacted insurance Company State Farm and worked with them on what needed to be done, They advised me that I had the GAP insurance that they would take care of the other half of the balance owed, so I access the number and called in to find out whats needed to file my claim, so they send me the claim pkg and my troubles and worries began, with GAP, just Fyi I was working 2 jobs at the time and there is only 24 hrs in a day in which I work 16 to 18 hr days from time to time so I just have nothing but time to sit and talk and call !!!

So I go to my ausome insurance agent and ask him to heilp me and I guess they think Im the only cstomer he works with, anyway he hels me out in the best way possible and even he from time to time would wait for hours on hold with time and speak to someone and be told one thing and then next thing you know he gets it faxes over what they ask for and then I call and contace them and then be told ooh no ma"am we need 4 forms they we can start on our claim so here I began going to the car company going to my insruance agent day after day but keep in mind most offices and business close at 5 and I get off most of the time about 2:45 to 3:00 on a good day, ooh and don't let me forget to mention that I drive 45 mins to and from work.

Ok so in October of 2016 State Farm pays their portion on the balance of my car owed, keep in mind they keep in contact with me notifying me of any add'l info needed and it was sent so whatever they ask me to provide it was sent and done and yes it took them a lil bit but they got it settled, so back to GAP! I called and called and checked on statuse and would constanly be told you need this you need that and when we get it then the adjuster will file your claim, ok so I send in all paper work to GAP they tell me we need a copy of your payment history,so I contact my loan comp and obtain the payment history they sent me  and send it to the GAP claims office and ask ok so they can get started now, umh no maam we need a copy of the retail Installment agreement ok anything else no maam that will get the agent started ok, so I go to they library and acess the retail installment agreement and send it to them, I wait then call them yes we recieved it but we can read it , ok well ill see what I can do to make the print bigger so I do that and so we have went into about this time we are about in the end of october into november and I fax over another copy of the retail installment contract and they say again they can't read it , Im like I don't know what more I can do Im looking at the agreement and I can read it the rep then says well ok can you give me the numbers that I need off of it and I can fill that in for you and give it to the adjuster, Im like well dang why didn't the other reps I spoke with do that instead of wasteing time and  money?

So he takes my info and I feel like thank you Lord that's done we can finally get this process going so I ask the agent ok so the adjuster can get started now right? No, umha maam we need you to cancel the resistall contract and the dent guard contract and once that is done then they can get started!!! WHAT well why didn't they tell me this a long time ago when I was doing all the faxing of the installment agreement that could have been done then also, ok so whom do I need to contact to get the contracts cancelled agent: you contact the dealership they will be able to do that for you, me

:ok so I go to Chevy dealership and talk to finance mgr and let him know what was needed for me to finish up on claim about this time it is the end of November right after thanksgiving and before christmas so I constantly go to the dealership call the dealership asking the finance mgr to get the paperwork needed to get the gap claim started it took them 2 months to get me what I ask for then they submitte it to Gap and they tell me ooh ok well we need also your full payment history fro m the begining of the contract to the last pay date and here I go again because the payment I sent wasnt from the begining and I let them know yall just said payment history and what I had accessed that's what I sent so I contact the bank and request that I get the full payment history while waiting for a response back from the bank I recieve a letter from the gap stateing they are paying the balance less 1,856.00. Keep in mind this is a whole new year we are in and this claim was filled in  08/2016 and we are now in 3/2017 so call Gap to find out why they are not going to pay the balance of 8,096.89 that is owed which will leave a balance of  1,856.00 in which they expect me to pay, so I call in and speak with  lydia L because they for some reason don't have id# numbers apprently and can't give out any other info than that she is out of the Houston office and apperently she " is the only lydia" that works from this office, I explained to her that this has taken a long time it has been a long frustrating journey and they run around on what was needed and all the lil details need to get the claim going, and that I was very upset with the company and how they conduct business and treat customers and it is very dissatisfying and a stress upon the cunsumers when they have to try and figure out what they need instead of just telling them whats needed the first time around.

She wasn't apologetic, she didn't seem to care that I was in disstress about this and that I was doing all the work she went to explaining and then the thing that struck me the most was that she in other words told me it was all my fault because when I signed the contract for the gap that was stated on the contract they will not pay for any prior damage and they don't cover late payments and that basically I should have known that cause it was on the contract I signed 2 years ago, ok so who in the heck will remeber every lil detail of what was said and done 2 years ago and mind you this is 2017 so 3years ago I should have remebered every peice of information on the dang near 50 pgs of paper work I signed 2 to 3 years ago that was probably in the small print of the paper work, I then said well maam do you remeber what you did and was doing 2years ago on this exact date and what you said and what you ate and what time you woke up? I then ask her what date and year is this she responded you know what the date and year is I don't need to tell you that! I said well then I should have to tell you that I have been dealing with you rude a*s agents that don't give all the information needed to file my claim and get this resolved its not my fault yal suck at your job and can't get yal ish together, as much time and gas and energy and the stress I've went thru to get this done and payed yal owe me money, she then said she wasn't going to continue to talk to me and that she was going to hang up on me if I didn't calm down and she didn't have time to go around and around with me on this issue and they paid all that they are obligated to pay!!!

I ask for a supervisor and I go a rude disrepectful jack a** that was ruder than lydia, he told me that "Its comon sense that I send in the payment history from the begining to the last payment that should not have to be explained to me or anyone else" and quoted that we had been on the phone for 45 mins going around and around and was getting no where and I told him ok thats what I've been telling you that I call and get nothing and no where when I call and talk to your customer service reps, I had left several messages on the automated system and no one has called or contacted me in any way so whats the point.

I explained to the Superv David P. that this has been a long process and that if you don't know anything about insurance and how it all works then yes you will send in the paper work you feel is needed but when someone says payment history I sent in what was avail to me and that they needed to be more specific in what they need , I used the example that if a 70 to 80 year old person called in and ask what is needed they will get what they have access to and send it in and if you don't tell them you need the payment history from the begining to the last payment they will send you what they have, he turn and said I have spoke with several 70 and 80 year olds that know that its common sense, I went off this is over the top and of all things this is a company and a business and they are over the top and rude and disrespectful manner and I let him know they are customer service baised and should know how to help thier customer out in any way possible, because if I along with other customers didn't have the GAP insurance they wouldn't have a job!

I ask for his managers Name and how I can write in a complaint, he throughs out the information really fast with an attitude, the call eneded and then I go to call back to make sure the information given is correct and to find that he was rushing me off the phone call because it was quitting time. guess what I hope it is a permant quiting time for this man and the lady I spoke with and Im not one for getting people fired but they arent customer service oriented people and don't value their job the customers that bless them to have thier job, rest assured that this will not be the last that they hear from me on this matter. Is their anyone out there that can help me with getting this resolved of if they need to pay or direction on what to do about this?

They were right....you should have known this. So taking it from the top, in short you were taken advantage of but not in the way you think.

Insurance companies are NOT your friend, when you have a claim the adjustors job is to pay as little as possible and State Farm is no different. They saw you coming with the "GAP" insurance and figured they could low-ball you on your claim. Where you would be more than happy to accept because you had "GAP" insurance that covers the difference. The agent "playing" your pal while not directly part of this, knows that if he could keep you happy you would probably accept less without putting up a fight. Where what is good for the company is good for him.

But guess what, you are under no obligation to accept their first offer if it isn't fair market value. So if for example they offer you $10,000 but the fair market value is $12,000 you can fight for the $12,000 and if you can prove that they are low-balling you...you can prevail. This is what you should have done FIRST and once you got the best offer settlement you could, then and only then do you worry about the GAP coverage.

Now, back to the GAP insurance. There isn't a single GAP policy that will pay for late charges, repo fees, previous damage. GAP covers one thing, the remaining balance based on your regularly scheduled payments minus what ever was paid by the other insurance company. So for example, if you had $500 in late fees and extra interest. Those are YOUR responsibility. You are not expected to remember all of this, BUT at the time when you sign up for the insurance, it is YOUR responsibility to be sure you understand what it covers.

FYI to have over $8,000 in Negative Equity(the amount still owed after SF paid) after 3 years of payments means you either got a REALLY BAD deal for the car in the beginning, you have been severely late multiple times, or as I mentioned earlier your insurance company really low-balled you and got you good on the initial settlement. Or perhaps a combination of all three.

I understand this is a lot of "armchair quarterbacking".  But hopefully you will learn from this moving forward and be a lot more critical before you not only buy another car, but if by some bad twist you have another accident you take control of the situation with the insurance companies. One final item the whole "I work 2 jobs..blah..blah..blah" is just an excuse. If the accident was your fault then you have to take responsibility and that means that you may have to decide between work and dealing with the claims. Again, if this was an issue this is something YOU should have researched before you purchased any insurance. Now, if this wasn't your fault then you should be making a claim against the other person's insurance for lost time from work when you have to deal with this. That may be a bit of a fight, but again it can be done.
