Child support has been a long time coming for Erica, Ashley and Samantha Abernathy as the issue of child support was reserved when their parents divorce was final in 1995 since their father Randell Abernathy had been sentenced in 1994 to 20 years for sexually assaulting both Erica and Ashley.
Despite the fact that he was released from prison in October 2003 it took over a year before he was brought to court for the issue of child support. However, the courts ordered both current and back child support for the children and an amended order was entered on April 15, 2005.
Then, after June 29, 2005, Mr. Abernathy decided to quit paying the $83 a week in court ordered child support. So after numerous phone calls by their mother Teri Colglazier; on September 30, 2005, the Illinois Department of Child Support Enforcement sent an Order/Notice to Withhold Income for Child Support directly to Mr. Abernathy's employer: Gary Gaehle; of Custom Imprint Designs, Inc.; 1904 #B West US Highway 50 in O'Fallon, Illinois for $100 per week to be withheld from his wages (due to arrearages and interest penalties).
That should be the end of the story as Illinois Statutes (750 ILCS 28/35) state that an employer will be fined $100 a day for failing to comply with an Order/Notice to Withhold Income for Child Support.
$200 was withheld from Mr. Abernathy's paycheck for pay period October 15 October 28, 2005.
$200 was withheld from Mr. Abernathy's paycheck for pay period October 31 November 11, 2005.
November 17, 2005 and still no child support had been received anywhere. Ms. Colglazier contacted the Illinois State Employer Non-Compliance Department to report that Custom Imprint Designs, Inc. was not forwarding the child support and was told that Mr. Abernathy had already reported on November 15, 2005 and that the case was pending.
$200 was withheld from Mr. Abernathy's paycheck for pay period November 14 November 25, 2005.
On December 2, 2005, in an effort to verify the phone number of Custom Imprint Designs, Inc. Ms. Colglazier ended up calling the neighboring shop instead. They didn't have the phone number of Custom Imprint Design, Inc. but offered to go get someone who could help. The man who took the call identified himself as Dave and the owner of Custom Imprint Designs, Inc. However, when Ms. Colglazier identified herself he became hostile and stated that he had mailed the checks and had proof and that it was Ms. Colglazier's problem not his.
According to the Illinois State Employer Non-Compliance Department Mr. Gaehle contacted their office on December 2, 2005 and stated that he had sent the checks. Thus removing the case from the pending file.
$200 was withheld from Mr. Abernathy's paycheck for pay period November 28 December 9, 2005.
On December 12, 2005, the case was returned to pending in the Non-Compliance Department as no payments had been received.
It is unknown whether or not child support was withheld from Mr. Abernathy's check from December 12 December 23, 2005 as according to Mr. Abernathy; Mr. Gaehle has thus far refused to pay him as Mr. Abernathy quit effective December 23, 2005.
To date, none of the child support payments withheld from Mr. Abernathy's checks have been forwarded to the Child Support Disbursement Unit in Carol Stream Illinois or anywhere else.
When a representative of the Illinois Department of Child Support Non-Compliance Department contacted Mr. Gaehle on December 22, 2005 he told the representative that he sent the checks to the address he was given and hung up on her.
One missing check? Perhaps.
Two missing checks? Highly unlikely.
Every check missing? It is quite obvious that Mr. Gaehle of Custom Imprint Designs, Inc. had himself a very Merry Christmas at the expense of three children in Central Illinois.

I would like to clarify and get to the bottom-line of all of Ms Colglazer & Mr. Abernathy's allegations regarding this matter. As the title says, Ms. Colglazer spent months trying her "get rich" scheme to screw someone else. This matter was heard in the Illinois Civil Court and the Honorable Judge Renard found no misappropriation of funds that Ms. Colglazer claims.

Despite a court order for payment of child support and court costs, Gary & Kay Gaehle have made no payments as of July 8, 2007.
Gary Gaehle stated during a phone contact that it would never be paid.
It is noteworthy that Gary & Kay Gaehle believe they are above and beyond the law and having to follow the courts orders, once again forcing this Plaintiff to return to court for further rulings on this case.

The accusations made by Teresa Colglazier are totally false and slanderous. The matter regarding child support for her children has been resolved and I have been cleared by the Illinois Department of Child Support Enforcement of any wrong doing, regarding the payment of the child support granishment.
The problem occurred when an incorrect mailing address was put in the computer for where the payments were being sent to the State of Illinois. The problem was not immediately known, and checks were being sent within 24 hours of when they were withheld from Mr. Abernathy's pay check. However, because of the address mistake the checks never made it to the correct place and the problem was not found until copies of the remittance advices were sent to the State Child Support Department and the employee I was working with noticed the wrong address.
After investigating the problem, and working with the State of Illinois the problem was discovered, there was a stop payment on the original (4) checks and a replacement check in the amount of $800.00 was immediately sent to the State of Illinois to resolve the problem. After the check was received, I received notification from the Illinois Department of Child Support that the issue had been resolved and my account was in good standing.
In addition, because I have been harassed by Teresa Colglazier constantly claiming that I owe here thousands of dollars in fines, I sent a letter to the Court of the Eleventh Judicial Circuit in McLean County, Illinois and requested that they notify her that she has no claim for these fines. Only the State of Illinois can impose such fines and my account with the state has been returned to good standing. I believe that any "normal" human being would agree that I in no way "stole" or "willfully and contemptuously" failed to comply with the order as Ms. Colglazier claims.
The real issue here is that Mr. Abernathy (her ex-husband) is a total deadbeat. It amazes me how the State of Illinois can give Mr. Abernathy $200.00 plus monthly with food stamps when he owes thousands of dollars in back child support. Mr. Abernathy was given every opportunity to start his life over. My wife and I felt sorry for him, gave him furniture for his apartment and were supportive in every way. Not one time did Mr. Abernathy go home without a paycheck, or was he ever sent home when there was no work for him to do.
Mr. Abernathy received a dollar an hour increase in pay in the two years he worked for me. When he left my employ (walked out) he owed the company $ 150.00 for money I had loaned him to keep his electric from being shut off, and had never mad a check in the amount of $50.00 good that I held for more than 6 months. As the owner of the company my paychecks have been scarse and most of the time not at all because it was a new company just starting out.
In addition, Mr. Abernathy almost immediately had all the conveniences of the normal family. Cable television, internet access and was buying goods that he definately couldn't afford. In addition, he smoked cigarettes constantly. That is how he got himself into a financial bind.
In addition he met a lazy slob of a woman on line and almost immediately she moved in with him. I even was stupid enough to drive the two of them over 150 miles to pick up her belongings at her ex-husbands place and didn't charge them a dime. She is a lazy bum that has no intention of finding a job and I am sure that is how Mr. Ambernathy got the food stamps.
I warned Mr. Abernathy on at least 6 occassions that I did not want her in my store when I was gone, only to find out that she was there, snooping through company files and who knows what she walked off with.
As far as Mr. Abernathy, in my opinion he needs to be sent back to prision to finish out his sentence. He lied to me about what he did to get sent to prision. He fabricated a tale about a girl that he met on the internet, she indicated she was 18, and after they had sex she yelled foul play. Had I know the truth, he would never have been given the chance to work for my company.
I have two teenage daughters that were in and out of the store all the time, and even at times were at the store with Mr. Abernathy when I was not there. What employer in his right mind would put his own daughters in jepordy of being molested by this convict. If he thinks he will ever get a recommendation from me as a prior employer he is sadly mistaken.
If I were a violent individual he would be "dead" by now for all the lies he told me. And his most recent deed was to file for unemployment. I have at least three customers, one other employee and a delivery driver that all indicated that Mr. Abernathy told them he was going to leave my employ and make a good living doing digitizing. I wonder if he has indicated to the State of Illinois Department of Employment Security that the checks for his digitizing are being sent and deposited in an account in the girl friends name.
I believe that is considered fraud. And what about driving an automobile for more than two years without auto insurance. It certainly makes one wonder what the Parole Board and parole officers are getting paid for. They certainly aren't doing their job to allow such things to continue.
I have recently written to my congressman and senators regarding this individual. How can the Department of Employment Security call a prospective employer and ask them to consider interviewing an individual that has such a criminal background without revealing what the charges were. I understand and individuals rights to "privacy" but not when it is for such a devient crime.
As far as Ms. Colglazier is concerned, if she spent half as much time trying to find and keep a job as she spends trying to manipulate and get money from people she would be very wealthy individual. When I showed her "demand for settlement" to my attorney he laughed and noted that she must spend all of her time dreaming up quick get rich schemes.

On December 23, 2005 Gary Gaehle/Custom Imprint Designs, Inc. allegedly withheld $200 from Mr. Abernathy's paycheck. (Documentation is unavailable as Gary Gaehle/Custom Imprint Designs, Inc. has willfully and knowingly failed to comply with 820 ILCS 115/5 by refusing to issue Mr. Abernathy his final paycheck.)
On December 27, 2005 Illinois Child Support Enforcement Employer Non-Compliance Unit sent certified reminder letter to Gary Gaehle/Custom Imprint Designs, Inc. (Per United States Postal Service re: Certified Mail/Signature Confirmation Second/Final Notice: 5 days after first notice; Return Date (Total Days Held): 15 days)
On January 6, 2006 Mr. Abernathy posted a public statement regarding the Employer and the issues surrounding the child support. (See ripoff report http://www.ripoffreport.com/reports/ripoff170749.htm)
On January 9, 2006 Illinois Child Support Enforcement Employer Non-Compliance Unit representative noted that certified receipt had not been returned
On January 14, 2006 a settlement offer was sent by Teresa R. Colglazier via Certified Mail/Signature Confirmation to Gary Gaehle/Custom Imprint Designs, Inc. to both business and home addresses.
The settlement offer stated that as of January 25, 2006:
1) $1,200 is owed by Gary Gaehle/Custom Imprint Designs, Inc. to the Illinois State Disbursement Unit (RIN# 116185547) per 750 ILCS 28 Section 35(a).
2) $108 in interest is owed on $1,200 child support arrears by Gary Gaehle/Custom Imprint Designs, Inc. to the Illinois State Disbursement Unit per Senate Bill 95.
3) $31,200 in fines and/or penalties is owed by Gary Gaehle/Custom Imprint Designs, Inc. to Teresa R. Colglazier on behalf of her children per 750 ILCS 28 Section 35.
4) Penalty calculations are upheld in IRMO Chen and Ulner, 354 Ill. App. 3d 1004, 290 Ill. Dec. 69, 820 N.E.2d 1136 (2d Dist. 2004), Grams v. Autozone, Inc., 319 Ill. App. 3d 567, 745 N.E.2d 687 (2001) (Third District), Dunahee v. Chenoa Welding & Fabrication, Inc., 273 Ill.App.3d 201, 209 Ill.Dec. 898, 652 N.E.2d 438 (4th Dist. 1995), et. al.
The settlement offer was as follows:
1) $1,308 payment to Illinois State Disbursement Unit for Child Support and Interest
2) $25,000 payment via valid and verifiable certified bank check to Teresa R. Colglazier for fines/penalties
Settlement offer is valid until January 24, 2006 at 11:59 pm.
