We leased 4 trucks on with Genesis and leased trailers through their company, 4 Horse Leasing. When we initially talked to them about signing on with them, we were told that we would average $1.42 - $1.45 for all miles. After hauling for them for 10 and 1/2 weeks we averaged around $1.17 and told them we were going to pull our trucks. During that time we were paying in escrow money. All trailers were returned with the last load on Aug. 3. We were told that our final settlement would be in 30 days. We received a certified letter on Sept. 17 stating that through a breach of contract with 4 Horse Leasing, all final settlements and escrow money would be made payable to 4 Horse Leasing. This amounts to approximately $5500. We don't know the exact amount of this because we have not received a statement for the amount of the settlement with the deductions listed (they are required by law to furnish this). Genesis is legally able to keep our money through their not very honorable practice of having a seperate lease for trailers through a different company, namely 4 Horse Leasing. This is a practice that several companies use to bilk drivers out of thousands of dollars. We leased on with this company in good faith and shame on us for thinking we would be treated likewise. Owner/operators, just be aware that this company is like so many others, they will find a way to keep your money. We had to go through every settlement carefully as there were constant mistakes (12 to be exact) in the settlements with wrong deductions being taken out. We don't recommend doing business with Genesis Trucking & Logistics or 4 Horse Leasing.

Stewmann Trucking has used this format to air their frustrations of not getting their ecsrow monies back and having to pay a legitimate debt and damages that they have incurred. First off, if Genesis Trucking & Logistics or 4 Horse Leasing had done anything illegal, as Stewmann Trucking has accused us of, then why did you not bring legal charges? I will answer that question for you, because it is not Genesis or 4 Horse that has done anything wrong.

You were told that at Genesis in 2009 the fleet average for an O/O was $185,000 to the truck after brokerage. This calculated out to $1.42 per mile to the truck in 2009. I am happy to provide any proof needed to prove this fact. You were also told that this number was based on loaded and empty dispatched miles. Your $1.17 a mile is based from your doorstep to your doorstep. No one that I know in the transportation industry calculates their advertised mileage like that. We are a reefer company and you knew that.  But in your hurry to put trucks on with us, you made a deal to have us try a dry van against our advisement. This is what contributed to your lower CPM along with the drivers who had to be home every weekend. This is not what we had agreed to. You still made $1.31 CPM for all miles loaded and empty while you were here. The $1.42 CPM is an ANNUAL AVERAGE.

As for the monies retained by Genesis/4 Horse you totally destroyed a trailer. It was sold to the insurance company - I have pictures of this unit if you would like to see the damage. Then there is the pending insurance claim that you left without addressing.

Genesis/4 Horse had agreed to purchase 4 trailers for Stewmann Trucking to enter into a lease agreement to use for one year. Stewmann Trucking read and signed the agreements - I have copies of these agreements that include each page initialed that it had been read and understood. The escrow account was set up for damage to equipment and the use of our fuel cards.

When it comes to non payment claims, "People who live in glass houses should not cast stones". You had drivers who quit because you did not pay them - I have names of the drivers.

I would like to let everyone who reads this complaint know that I once again strongly suggest that everyone who does business with Genesis Trucking & Logistics Inc. or 4 Horse Leasing or for that matter any company who uses a contract to conduct their business that "You read the contract in it's entirety and ask questions BEFORE you sign them". Contracts are drawn up by attorneys to protect both parties in a dispute and it is too late after you have signed it to want to negotiate or change the terms of the ageement you have signed.
