I purchased a truck from Georgetown auto sales and put $6000 down and have since paid over half of what's owed on the truck, but due to some financial problems, I fell behind in my payments and I contacted them to let them know that I would have the money to bring my payments current and they led me to believe that they would work with me, but instead they re-poed my truck and now they're telling me that I have to pay the balance owed in order to get the truck back which wasn't stated in our signed contract nor did they state that verbally to me.  I feel that they are ripping me off because I've already paid more than half of the purchase price and I'm able to pay my late payments to bring my account current but they're not willing to work with me because they probably want to try to resell it to someone else after I've invested over $12,000 in this truck.  I intend to contact my lawyer if they don't abide by our signed agreement/contract.

I intend to contact my lawyer if they don't abide by our signed agreement/contract.

It is amazing how many people complain that the dealer/finance company is not holding up their end of the contract when THEY are the ones who became delinquent.   Your contract required you to make regular payments at a set time for a set amount.  It also put your truck up a collateral where if you did not make these payments they have a right to repossess the truck.  There was NOTHING in your contract that said you only had to pay when you could.  It is also not your truck until you have paid it in full.  So they could repossess your truck if you owed as little as $1 if they wanted to.  Once it is repossessed they have a legal right to ask for the balance due.

Here is an idea instead of spending money on a Lawyer who will basically tell you that everything they did they had the legal right to do.  Use that money to pay off your truck.

Now, if you don't get the truck back they will sell it at auction for a fraction of it's value.  Depending on exactly how much you still owe on the truck you may have a balance on the loan after they apply that to the loan.  If you don't pay that they will start up collection efforts on that balance and may eventually sue you.  Oh and this is also exactly what your lawyer will tell you.

   Are you positive that your finance contract doesn't say this?   The reason I ask is that I've never seen an auto finance contract that did not have that clause.   Some of them have an option to bring the loan current plus late fees and repo charges, but that is always the option of the lender.

   If you got a sub-prime or buy-here-pay-here loan, they usually don't even have that option. They figure you were on thin ice when you took out the loan and don't want to risk default.
