I signed up for a "free sample" for a quit smoking aid.  I thought I was getting a small "starter" kit for $9.95.  Little did I know that I was getting the whole kit & I had a 10 day trial in which I had to send it back.  I ordered the product & was charged $10.25 for "shipping" on 10/14.  On the 26th of that month, I received an e-mail telling me that due to an overwhelming demand - my package would be late, so they were extending my now "trial" to 17 days.  On November 1st I received an e-mail offering me tracking for my package.  On 11/9/09 I received my kit.  On 11/10 my debit card was charged $99.99.  I called this co. (which took some work getting the number) & they told me that all was explained to me in the "terms & conditions" fine print on bottom of ad.  I told her that I had received my package on the 9th & she told me that they would extend my "trial" for 4 more days.  Now I have to mail this crap (pay for shipping again)back to England & have some sort of tracking put on it.  Fat chance they'll receive it in time w/o me paying a fortune.  Plus part of the $99.99 charge taken out of my account was for shipping?  Again?  That's 3 times I will have paid for shipping?  I called my bank (BB&T) and they said there's nothing they can do because the charge in in a "pending" stage - however the money has been taken out of my account & since I had no idea it was coming - over drew my account for $105.00 in NSF fees.  My debit card has been frozen, and the cost for the shipping to England w/ tracking will be costly.  Now all they have to do is tell me they didn't receive it in time and I'm screwed totally.

#3 Consumer Suggestion

Read The T&C

AUTHOR: reckless - (United States of America)

POSTED: Friday, January 08, 2010

First of all I would point out that there seems to be some confusion on this site. Some are complaining about e-cigs and some about actual cigarettes. The two companies are both different.

I'll comment on the e-cigs. I bought one on the 'trial' and it is just that... A TRIAL. At the end of the trial they charge you for the full $99.99 (I saw it on the credit card page!) They could give you longer to try it but you can't complain about something which you were shown before you bought it. Nobody held a gun to my head to buy it and I do like it. I'm down to 5 normal cigs a day and the Smart Smoker.

#2 Consumer Comment

Exactly the same thing with me

AUTHOR: John - (United States of America)

POSTED: Monday, December 28, 2009

Exactly the same thing with me, I am refuting the company representatives rebuttal, I am refuting the rebuttal as not at all accurate or even truthful. I was a consumer who did not see any fine print and was reassured with the following invoice:

Item     Description     Quantity                    Price     Total
102PL     Smart Smoker Kit - Free Trial     1     $.00     $.00
    SubTotal     $.00
Shipping & Handling                                               $9.95
Tax                                                                      $.00
Order Total                                                          $9.95

THEN, about 20 days later, the $99.99 charge appeared on my CC statement, in addtion to the previously agreed to $9.95.

Now if there was any way to contact the company, I would return the item in a heartbeat, but the two emails I received are from "no-reply@getsmartsmoker.com".  How handy is that, of course, not a phone number anywhere, and how much does it cost to call England if you do find a number.
I am going to attempt to report via my CC as fraudulent charge, no where was the $99.99 charge indicated.

We refute this claim

I would just like to say that the "fine print" at the bottom is in fact a box larger than the button you have to press to submit the order and is purposely put right by the submit button so it can not be missed,I would encourage anybody to see this, I also don't understand why you are complaining about receiving a full kit for the price of the smaller starter kit, we can only apologise for the delay by USPS in getting your kit, it arrived in New York on Nov 3rd but then took an extra 6 days to reach you, we can not be held responsible for this, you have not been charged twice for shipping, the $99.99 was the price of the pack, in fact the larger kit you received is $139.99, all you had to do was email in to ask to return it, you dont have to have it back in the UK within the time, just ask to return it, there is no scam and everything is clear.
