First of all someone called me from Wolf Law Firm and told me they were the collection agents for Providian Credit Card Company. I owed Providian around $2,000 since the late 90's. In the meantime, I had triple by-pass surgery and bi-lateral knee replacements. I have been unable to work since 2001.I did not know at the time that a site like this exists. I gave them my banking information. They have taken out regularly, each month since.
I have now paid the entire debt, finding out in the meantime that they bought this from Providian and it is going in their pockets and NOT Providian's.
I have tried since the first of the month to reach these people because they stated that I would receive a letter with the last withdrawal, which was the 3rd of August, that it was paid in full. Everytime I'm lucky enough to get someone on the phone, they listen and then 'transfer' me. Eash time I am cut off and eash time I call back they apologize and do the same thing.
I just wish I had the money to hire a lawyer to file a class action lawsuit on these scumbags. Thanks again Ripoff.com for being here.

You Do NOT Have to Deal With Credit Collection Agencies...EVER!

First of all, this does NOT mean you do not owe a debt. What this means is you do not have to deal with any credit collection agency.
Thank you, Nathan, for recommending BudHibbs.com.
There was a law passed where, if you send the collection agency a 'CEASE-COMM' letter, they HAVE to stop collecting from you.
You will, however, have to deal with the original creditor. It is unlawful to deal with ANY third parties. The best thing to do is to go to cap@BudHibbs.com and download his book which explains how to do this. It even tells you what to say in the leter. Another good thing about this is it is FREE! You download it to a PDF file. This site is a goldmine of information. We need a lot more people like Mr. Hibbs on our side. So, from the bottom of my heart I thank you again , Nathan , along with Mr. Hibbs and Ripoff.com.
Most times, the original creditor has 'sold' your debt to a collection agency. This is when they start to try and collect invalid debts.
There is also a law that says the collection agency CANNOT put this debt on your credit report. This is mentioned in the 'cease-comm' letter.
If we , as a whole, continue to fight collection agencies and their scare tactics, they will eventually be OUT of business. Good luck out there everyone!

contact Gordon Leech in Milwaukee, Wisconsin. also file complaints with FTC and State of wisconsin

Start by filing via the internet a complaint with Wisconsin Department of Financial institutions.
Then a complaint with the FEDERAL TRADE COMMISSION. Every complaint helps getting closer to putting them out of business like they did with Hilco Receivables in ILL.
From now on do not talk with them. If they do get you on the phone . Get the equipment from Radio Shack to record them.
Goto BudHibbs.com. The site is great to educate you on your rights. Your debt may be STATUTE OF LIMITATIONS BARRED.
also goto the site of the Wisconsin secretary of state. Find out if they are registered to do business in Wisconsin.
Keep this info under wraps as well as the recording. Call Gordon Leech in Milwaukee. He is an NACA attorney.
Keep us posted.

Contact an attorney who specializes in this area

A relative of mine was contacted by individuals working for Rodney Giove 3 years ago. When they passed on the information to me, I called the phone number given by a Giove employee. I was immmediately told to send a large sum of money because court proceedings were being pursued in my county. Because of these and other red flags, I began to record the phone calls to or from these people. I also contacted an attorney who charged no up front fee.
I eventually received a sum of money FROM Giove as they preferred to pay a settlement to me, rather than to go to court and face the many violations of the FDCPA.
These employees at Giove's office (as far as I know he is still a member of the NY Bar) are very intimidating over the phone and will even tell you they are lawyers. They are not allowed to identify themselves as lawyers if they aren't, even if they work for one. Stay calm and think clearly - and take pro-active measures to make sure your rights are protected. Good luck to you!
