#5 Consumer Suggestion

Do Not Deposit Suspicious Checks

AUTHOR: Stephen - (U.S.A.)

POSTED: Friday, February 20, 2009

I would not advise depositing the check. In most jurisdictions in the US, depositing a counterfeit check is a crime. In most cases like this, it is not prosecuted. However, some financial institutions prosecute vigorously. You would have a hard time defending yourself if you suspected the check was bogus and you opened an account for the sole purpose of depositing it.

In many instances, the hold may come off of the check which does not guarantee it is a good check. The funds becoming available and the check clearing are two different things. If the hold came off and you withdrew the funds and the check is subsequently returned, I could guarantee the FI would prosecute, if you did not return the funds.

The funds that are made available after a check hold is released are given under the provision that you presented a "good" check.

The consumer is always in the best position to know whether a check is good or not because they best know the source of it and are ultimately responsible for it.

The best advice when you receive a suspicious check is to ask yourself the likelihood of it being a good item. Any check you receive that asks for a portion of it to be forwarded somewhere else, is bound to be bogus. It is called an advance fee scam and it takes the form of fake lottery winnings, online purchases or auctions or work at home scams.

If it seems to good to be true, it usually is.

If you still want to inquire about the check, do not call any numbers listed on the check to verify funds. It is usually going to be bogus as well. If you bring it to your financial institution, tell them you suspect it is counterfeit. DO NOT DEPOSIT IT WITHOUT ALERTING THEM IT IS SUSPICIOUS!!!.

I am in the US Navy and recieved one of these letters. I took it to a JAG lawyer and he looked it over and verified it as a scam. My mother looked up the address from which it came and the address is an apartment building. Do not put this in your checking account it will not clear!
