On July 13, 2009 I paid Globe Tire & Auto Service (Globe) $2,271, to repair the Heater-Air Conditioning System of my 1998 Ford Taurus that was blowing only cold air uncontrollably. Globe has a Repair Warranty of 12 months or 12,000 miles which ever comes first.
On May of 2010 within the mile and time limits of Globe warranty the car was returned to Globe for the same Heater /Air system failure. Globe said the cars water pump had to be replaced to correct the malfunction and charged an additional $500 bringing my payment to $2,727. This extended the warranty, as it was part of the original service of 2009.
On February 2011 the system failed again, Globe quoted an additional $600 to replace a switch and heater door control for $600. I refused. At a Small Claims Case # Ber SC 002830-11 of September 9, 2011 with me as Plaintiff, Globe as Defendant. At the hearing Globe representative Mark Labos agreed to repair the system.
September 13, 2011 Globe had the car for 7 days after which the system still did not function. A Globe mechanic tested the heater confirmed its malfunction and said We have spent too much time and money on this and we will not do anymore Globe has breached its warranty and defrauded me of $2,727.
I bring to your attention to another Small Claims Case of March 14, 2011 Ber SC1331-11 with Globe as Defendant to give you insight into Globes conduct in these matters. Globe repaired a front wheel mechanism after which the same front wheel collapsed while the Plaintiffs wife was driving. Because he could not get the two mechanics, employees of Globe, to appear as witnesses and the court did not accept their sworn affidavits the Plaintiff had to settle for $150 for a life threatening defective repair and the additional costs to repair the damages Globe caused.
Small Claims cases show that when an automobile repair complaint is made the court requires an expert witness to attest for the plaintiff, thus judging that plaintiffs are unqualified to determine that their automobile has been defectively serviced, this is in contrast to defendants who, without an expert witness, are assumed, by the court, to be experts and not required to attest as witnesses. This is unfair.
