I recently leased a GM vehicle. I noticed the contract stated specific insurance coverage and requirements. I had the necessary coverage on collision/comprehensive which would concern the GMAC because it protects THEIR PROPERTY.

However, I received a letter today stating we don't have the correct amount of insurance as specified in our contract. Everything they listed in their letter had to do with liability and personal injury! This has NOTHING to do with protecting the interest of THEIR PROPERTY!

My friend Joe nailed it on the head. GMAC WANTS you to be in violation of that contract so they can FORCE a policy on that vehicle!

I would venture to say they probably use their own insurance company (GMAC Insurance) when forcing a policy!

I'm all too familiar with FORCED auto insurance policies. Fifth Third Bank pulled that stunt on us some years back when they claimed that they had no proof we had our van insured. Regular declarations had been mailed to them FOR YEARS. They just didn't want to look very hard. It was pure hell trying to show Fifth Third that we had been covered all along, and to take back their new car payment book with DOUBLE the monetary payments. ($400 for the car payment and $400 for the insurance....PER MONTH!)

So BUYER BEWARE! Check your insurance policy against what GMAC demands.

Just wanted to know you keep saying its a scam to force insurance on you: so have you been paying an extra charge every month for forced insurance? If it is indeed a scam then you should be a victim right? to even be upset about it?

You notice the VP's of these major companies don't answer these compliants because they know better....

GMAC is robbing people blind and until YOU learn how they do it...KEEP your mouth SHUT....everyone is entitled to an opinion...however, I just don't seem to have the tolerance anymore to deal with ignorant ones...

DO YOU know that GMAC own employees filed a class action against GMAC because GMAC was discriminating against their very own employess that purchased GM cars.... NOW HOW LOW can you get... dishonest to the very own people that make your business stay functional....

GMAC settled on that CLASS ACTION...so AGAIN...before YOU (Ellen) open your mouth...KNOW THE FACTS...

Ellen...I still don't think you are getting this. And maybe I didn't make it clear enough when I capitalized the words for you.

Again, I will bet paychecks that in the end, this is a scam to FORCE an auto insurance policy! No....GMAC may not be doing this themselves. However....THEY WILL NOT leave themselves vulnerable! I will guarantee they have CONTRACTORS who do the dirty work and FORCE insurance policies for on behalf of GMAC!!!! (And probably avoid "conflict of interest" illegalities when doing this since it will be "another company" forcing a GMAC policy....)

And that's what the gist of this is about, and what half the post is written about: FORCED INSURANCE POLICIES!

Again, BUYER BEWARE! FORCED POLICIES have become a major problem for consumers! And GMAC's leased contracts might just be setting you up for this to happen with their coverage demands

Bill-

Just a couple of points in my final post:
I am a lady, not a gentleman. Never met any gentlemen named Ellen, but I suppose there could be one.
I am mystified that you would sign a contract knowing the terms, and then call it a ripoff.
I wish more customers would walk away and take their business to someplace more competitive if they are so inclined, rather than accept terms they don't like. GMAC has the right to set the terms of its contracts, you have the right not to sign them.
Just for the record, I am not especially loyal to GMAC. I have never owned a GM vehicle, and my personal vehicle is a honda civic hybrid. But regardless of who I work for, I believe in honesty, truth and fairness. I was hoping to help you out and educate you if possible.

Next time read your entire lease agreement before you sign next to the X.

I did read it. However, I assumed too much. My last agreement was through Ford, and they only showed a concern regarding the COLLISION aspects of the policy, and not the other non-sense.

The issue of FORCED INSURANCE POLICIES continues. The lenders have just found unique ways to make someone else pay the bill instead of themselves.

If you were really trying to help, I appreciate it. However, there isn't much you can do against these big corporate rip-off artists. They have you coming and going.

If you only knew me and HALF the stories of my life.....from math errors that the IRS has made resulting in the threat of a sheriff's sale on my property....to the accidental omission of a pay-off on my dear 87 year old mother-in-law's home which almost resulted it it being foreclosed upon....you would be cynical as hell, too.

Many have suggested I need to write a book about my experiences. It's title would simply be "Someday, Someway,....You Are Gonna Get Screwed!"

Thank God for websites like this.

I read it and understood it the first time. I didn't state you didn't have coverage. My point is that if there is a provision in your state law that the OWNER of a leased vehicle (not leassee) may be sued for property and personal injury then they may be within their rights to set the minimum PL coverage a leasee must have in force. I'll assume that you can choose what insurance company you have the coverage through.

IF on the other hand, the law that CONGRESS passed about 2 years ago applies to your state (THEY CANNOT BE SUED if you have an accident) then they have no cause for setting a minimum PL coverage amount and that may be actionable.

I think it's worth you checking into it. If the federal vicarious liability restriction is in force in your state, then they may very well be violating the federal statute.

Perhaps you should "re-read" things before you tell others to do so.

To the first gentleman sticking up for his former employer:

That's why financial institutions (LIKE GMAC....), have adopted to hiring CONTRACTING AUDITORS to find these so-called insurance delinquints. Nice little direct, off-the-top tax expense.

To the other gentleman: Please read again. This isn't about not having any coverage. It's about GMAC setting extreme limits.

As stated in my post, $500,000 worth of coverage isn't going to prevent you from a lawsuit any more than $250,000 worth of coverage. That's why Michigan's state government, along with Michigan's Chamber of Commerce and other business leaders, are going to put a stop to this collusion by insurance agents and lenders like GMAC who demand extreme PL-PD limits.

I'm paying the extra insurance premiums. In the mean time, I've notified GM's partners....OnStar and XM Sat. Radio....that because of GM's extreme insurance requirements, that we won't be subscribing to their services. I've also mentioned that it might be in their best interest to meet with GM/GMAC and ask WHY GM/GMAC is requiring the high coverages which is resulting in customers (such as myself) from subscribing to thier partnered services of OnStar and XM.

Vicarious Liability

You should check your state laws regarding vicarious liability. NY has an old law on the book that the OWNER of the car can be sued for personal injury as well as property damage-including lease vehicles.

I thought that Congress passed a federal law that vacated any state vicarious liability laws. For a while, no one would lease a vehicle in NY. After congress passed the liability law, the industry started leasing vehicles again.

I am a former US GMAC customer service rep, and was a lease specialist. Regarding forced insurance: GMAC stopped forcing insurance on anyone in 2006. All too often the coverage came about due to some sort of failure in reporting of coverage, often when customers switched insurances. On top of that, customers rarely read their mail, and all too often waited years before complaining, and then had a difficult time producing verifiable proof of coverage. Of course the charges were removed when proof was provided.

Simply put, because of the number of reversals, and the cost in manpower, it was cheaper to stop forcing insurance. Obviously they don't broadcast this because there are too many idiots out there who will drop their coverage. Your lease contract specifies the minimum coverage you should have. If you are getting nastygrams regarding a shortage in coverage, and you have verified with your insurance company that your insurance policy matches or exceeds the specified coverage, call gmac customer service and get the phone number to van wagenen financial services, who handles all their insurance verification.

Your problem is a simple bureaucratic paperwork issue, so don't get your shorts in a bunch. If for some reason you choose not to call them, no real problem. you will continue to get nasty letters from time to time, but they aren't going to pick up your vehicle, or force insurance on you, even though they have the legal right. By the way, GMAC customer service is 1-800-200-4622.
