On Nov.12, 2012 I faxed all required forms for a loan modification based on financial hardship. I have been unemployed for over 3 years and avidly looking for work since December of 2011. I have over 25 years experience in the metals industry and have been on many interviews, but no job. My husband is self employed as a steel broker. In March of this year,  we had to drop our health insurance due to lack of income. He is diagnosted with cardiac myopothy and takes medication for his condition. We own our home of 20+ years.

We have been able to maintain our good credit and make our house payments on time up to last month. Our income year to date is $33,000. We have been forced to only pay  only minimums on all of our lines of credit which is quickly getting to their limits. We donot smoke or drink, so our grocery budget is for food only. We have sold almost all of our personal belongings that had any value to pay bills. Our monthly expenses are around $4000, which includes a $2100 house payment.

Our cars are old and we are struggling just to maintain them. I have lost my front tooth due to peridontal disease and going to a dental school for treatment. We are on a payment plan to an attorney because Healthnet continued our coverage for two months that we did not know about. We are also on a payment plan to the IRS because we were unable to pay  ALL of our taxes in 2010, when we actually had some income. We also have borrowed money from friends and family this year.

We have been informed that we did not qualify for a loan modification because we did not meet their definition of financial hardship. I was told that their criteria required a death or divorce. I know of many people who got loan modifications from their lenders because their lenders wanted to do the right thing. Green Tree referred me to quicken loans because they have no intention of helping anyone in need. I would like to see a lawsuit for their misrepresentation of claiming to want to help homeowners with financial difficulties!

... as our "former lender" has played the same games with us.  First was a "special forbearance" from our "lender" in order to see if TWO people with numerous disabling conditions could obtain work - HAH, yeah.  Right.  Second was the actual six month trial period leading up to the modification.  OUR OWN ATTORNEY stabbed us in the back before the judge because we were not *informed* that the payments had to be made via money order - not a personal check which I had accidentally done on two occasions.  After taking our money for five months and leading us to believe that we were going to have our loan modified, they refused the payment for month six and returned everything we had paid for the previous five months.  In between that, nothing but head games, belittlement, ridicule and fun at our expense.  I grew up in this house and inherited it from my mother - that is all I have left of her.  My husband is a Veteran (and disabled).  I am disabled as well.  Now, if a lender is more than willing to kick a VETERAN OF WAR (again, whom is disabled) to the streets ... do you think they're going to care about anyone else?  No.

For ALL of the lenders, Freddie Mac & Fannie Mae ... it's ALL about the money.  They don't see any of us as human beings - they see our properties, and see dollar signs, that's it.  That's all we are to them.

Congresswoman Marci Kaptur (D) of Ohio is not only telling her constituents to "stay in their homes" if foreclosed on -  she's telling ALL American citizens to do so.  Perhaps SHE should be president!!!  It seems that she most certainly has our interest more at heart than "the Obamination of desolation" does - or, if you will - the fake human being sitting in the oval office that promised "We The People" all of this "hopey/changey" stuff.  Wonder how that's working out for the morons whom had voted him back into office?  He screwed America on the first round - what in the H**L made them believe he was going to change things on the second round??

Getting back to Congresswoman Marci Kaptur - I have to agree with her.  I'm a "nobody" but, I also say *stay in your homes* and refuse to budge.  Especially if your "lender" refused to show you the original promissory note with YOUR original signatures ... NOT a copy from M.E.R.S. (Mortgage Electronic Registration Systems).  If your lender does *not* have the original promissory note, if they cannot produce it ... it is ILLEGAL for them to foreclose on you.

Now, as for YOU Mr. Brian F corey (nice, you didn't even capitalize your surname?) ... did Green Tree Servicing bother to show Debbie and her husband the original promissory note on their home?  Or were they shown the M.E.R.S. copy like we were?  And did that copy have a bunch of "blackouts" as ours did?  And yes, yes - I read the "requirements" that you had posted (i) (ii) and (iii).  Um, dude - yes, those poor people DO INDEED FALL UNDER THE FINANCIAL HARDSHIP CATEGORY.  The problem is this: neither you NOR the lender you are employed with CARE.  Just like our former lender - THEY DIDN'T EVEN *LOOK* AT our latest application.  They simply tossed it aside and foreclosed on us without a single warning.

I'm calling upon ALL AMERICAN CITIZENS to stay within their homes if foreclosed on.  I'm calling on ALL AMERICAN CITIZENS TO STOP PAYING THEIR LENDERS.  What are they going to do when they are getting money from NOBODY?!  It's high time for a revolution people!!!  If EVERYONE stops paying their lender - ALL of the banks as well as our government will begin to take us seriously.

"Before initiating any foreclosure on a mortgage loan , a Green Tree Foreclosure Specialist reviews the account being considered for foreclosure and confirms the following (i) the existence of a default that has not been cured; (ii) compliance with applicable legal requirements, such as pre-foreclosure defaul notices , counseling offers and mediation requirements;and (iii) that all reasonable efforts to cure the default or available loss-mitigation efforts , including Hamp or other modifications have been exhausted. "

Green Tree Servicing LLC denies almost all loan modifications . Their modification agenda is . They receive 162 million in WELFARE Tarp Funds . In 4 years they pay out a measely 7 million in loan mods . They foreclose on all the other homes and keep the 162 million . Giving the middle finger to an incompetent UNCLE SAM . Please be aware that Green Tree will do a lot of illegal things to people seeking loan mods , including attempting to foreclose on their property .
