I feel like an idiot for having fallen for this company's spiel. First of all, they called me, after sending me numerous emails about their company and how much money they have made by trading options and purchasing stock.

So, that's the setup. Then after they have bombarded me with emails about how great their company is, and all of the gains they have made trading (if I made that kind of money, why would I need to sell my services to anyone? Why waste my time unless I am a philanthropist?) Believe me, these people aren't philanthropists. They are in it to win it, and "it" is your money.

Anyway, I received a phone call today, and the salesman was very personable. Long story short, I was asked to purchase their subscription at a cost of $99 a month initially. I said, no. He then said $99 for three months, and that if I didn't like the profits I was making, then I didn't have to continue. I said no. He then said I could have a six month subscription for only $99, and I said that sounded better, but told hiim I wanted to have something in writing first. He then said he would send me the credit authorization form to sign by email. Like a dumb dumb, I gave him my information over the phone, not thinking of course that he could just go ahead and send the charge in to get the money without my written signature. Of course, I waited and waited for the email, then checked my bank account. The rotten piece of doodoo had already taken my money, and didn't even bother to pretend to send an email.

At that point, I called my bank, and they are in it now. I have had to cancel my credit card to make sure these )(*&)(*^)&%)% never get another cent of my money.

I know how tempting it is to read about these Wall Street geniuses making millions and giving you the opportunity to do so as well. But you have been told, and I am (too late) reminded, never give out your credit card number over the telephone. I am beginning to think we should never give it out over the internet either. Woulnd't that be a blow to all of the crooks, thieves, and miscreants out there? We need to protect ourselves, and stop being so gullible. It isn't funny, and could cost us thousands of dollars. Let's get wise, people. DON'T GIVE YOUR CREDIT CARD INFORMATION TO ANYONE OVER THE TELEPHONE, EVER, FOR ANY REASON. DON'T DO IT. And if someone rips you off, this is an excellent forum. Just be honest about it.

This is in response to the supposed lawyers for Gryphon:

You are representing a company which makes unsolicited calls to sell their services. Gryphon called me, I didn't call them. Also, you are misrepresenting their actions yourself when you report that I gave them a verbal authorization. I told them I wanted to see something in writing before I made a decision, and was told by the salesman that he would send it by email. The next thing I knew, I checked my account, that very day, just a few hours later, and found that my account had already been charged $99.

Now, I know that $99 is not a lot of money, but it is mine, and I don't want anyone getting it without my consent, and that is what these people did. Not only that, they never said anything about the money being non-refundable, which would have in itself been a warning signal. To me, any legitimate business will refund your money if the client is not satisfied, especially if requested within the month. I requested a refund immediately, and the woman on the phone said I gave them authorization. I gave them my card number with the verbal proviso that they first send me the authorization for my signature, which never happened. I received a credit card notification the next day, showing they had taken the money, not a written guarantee which I was to sign. They said I didn't understand, that I misunderstood, they make no refunds, etc. If they think I am stupid enough not to understand a sales pitch, then why would I have requested their guarantee in writing? The sales man later called me back after I assured this woman and her company that I WOULD get my money back,and said he was sorry that I apparently misunderstood. Well, I didn't misunderstand what he said, I understood what I requested, and they totally ignored my request and did what they wanted, which was to take my money. I DID GET MY MONEY BACK FROM MY BANK. The bank issued a credit back to me once I told them what happened,and they are presently investigating the matter.

To all of you who feel you have been cheated, misrepresented, or taken advantage of, do not be afraid to say so, and to ask for your money back. I wish more people would do research on these companies. Be warned, if they call you out of the blue, you are a sitting target for whatever reason. JUST SAY NO. JUST SAY NO. JUST SAY NO. Then, if you research them later, and have time to make a diligent and intelligent and informed decision, you can always call them back. JUST SAY NO TO ANYONE WHO CALLS UNSOLICITED TO ASK FOR YOUR MONEY. HANG UP OR SHUT UP! You won't be sorry. Thank you very much.

This response is being posted by Adorno & Yoss LLP, counsel to Gryphon Holdings, Inc. d/b/a Gryphon Financial (Gryphon). We have been requested by Gryphon to respond to the false and defamatory statements posted in Report No. 363045.

Frances signed up for a service with our client on August 14, 2008. That same day, Frances submitted the foregoing posting. He claims that our client agreed to send him a credit card authorization form to sign; however, Gryphon does not utilize credit card authorization forms, nor has it ever. Gryphon's clients must provide our client with authorization of all of their credit card information in order to be charged for a service. Once a customer provides that information, his or her credit card is charged, and the customer is sent a receipt of the transaction via e-mail. Once the receipt is signed and returned to Gryphon, the service is activated. In this case, Frances provided verbal authorization to Gryphon over the telephone. Once he provided such authorization, his credit card was charged for the service and he was e-mailed a receipt (not a credit card authorization form). Gryphon has in its possession a copy of the e-mail message that was sent to Frances, advising him As per your verbal authorization, we have charged your credit card $99.00. Attached is a receipt that we need printed, signed and returned to Gryphon Financial to activate your service.

We regret that Frances misunderstood the terms of the service; however, we maintain that Gryphon's actions were in compliance with the law and in now way a misrepresentation of the services they provide.

Gryphon has authorized Adorno & Yoss LLP to initiate any and all actions as may be necessary to prevent defamatory statements from being posted about its company on the Internet and will do so in the appropriate judicial forum, not on the Internet through an anonymous name.
