On 3/3/06 I purchased a car from a dealer that I got off the internet. The man came to my house I gave him $1700.00 in cash. The add stated that the car was in great condition. On 3/6/06 the car starts smoking. I took it to 2 mechanics and both of them told me that it was the engine. I called numerous times to Mr. Guy Victor and could not get a hold of him. On 3/10/06 he calls me back and I told him the problem. On 3/13/06 he had the car towed to his dealership. On 3/14/06 he calls me and tells me that it would cost an additional $1700.00 to fix. I told him that I wanted my money back and that he lied about the car. He hung up on me. Can you please help me.

I remember Ms Cari calling and explaining how badly she needed a car and the price was so right!!  She begged me not to sell the car until she could see it and drive it.  I asked when she could come, she replied she had no transportation and couldn't get there.

I explained to her I could not hold the car indefinitely without some sort of confirmation she wanted the car and a small deposit.  Since she could not give me a time or day she could come and begged me to bring her the car, even though it is not normal practice to drive vehicles to "show" people, I decided to be a nice guy and brought the car to her home.

After waiting almost 15 mins, she finally came out with her family, they all loved the car and she test drove the car, even though she didn't even have her license on her.  After the test drive, she said she loved it and wanted it.  I said great, you can come do all the paperwork at the office or we can do it here if you prefer. 

She replied she wanted her brother to see it because he was a mechanic.  I asked her what time he would be there and she replied we had to drive the car to his house to show him about 20 mins away! COME ON...ARE U SERIOUS??!!!  I didn't want to drive there after driving to her house from the dealership, but after again she begged me to, I did.  The brother drove the car, checked it out and told her it was a good deal and a great car!

She then hit me with, "I don't have all the money, I can pay some now $1700 and another week or two for the rest, which was almost $1000.  Once again, being a "nice guy", I accepted and told her I would be waiting for the balance. 

She then calls me and says the car started smoking, I told her to PARK the car and not to drive it if it was smoking.  Smoke is usually a sign something is wrong and the car needs to be looked at to find out WHY there is smoke. Sometimes its as simple as a hose needing to be changed...$6 bucks!

She DID NOT stop driving the car and continued to drive it until it stopped and she blew the head gasket, which was like blowing the engine.  If the car had an issue, 1) I would not have sold it 2) the 2 and a half hours it was driven the day she saw it between me, her driving, taking it to her brother (THE MECHANIC), and then going back to her home, we would have seen or heard something. 3) The brother, Mr Mechanic would have told her not to buy the car.  4) There would have been an issue sooner than almost 4 days later!

As far as the transaction went, the car, like all our vehicles, was sold "as is", meaning once sold, there was no warranty from the manufacturer or our dealership.  But, being a "nice guy", I told her I would see what I could do.  I got the car towed to one of the mechanics I knew and was told she drove the car while overheating and blew the engine!

I explained to her that he said it would cost between $1300-$1700 and I would forget about the additional $1000 she owed and she could apply that toward fixing the car, which I DID NOT HAVE TO DO!  She said she would take me to court and sue me, but I never heard back from her and didn't speak with her after that day and waited to go to court.

I knew I had done nothing wrong, and since I went over and beyond for her, as I usually do for all our customers, I knew I would win the case.  She knew she would lose so she started throwing dirt on our names and the dealership. 

Everyone deserves their day in court.  This is what the legal and justice system is all about.  If I would have been wrong, or found wrong in any court of law, I would have accepted the decision, even though I would have disagreed 100%, and dealt with it. I took a loss of $1000, paid for the tow and took her to a great mechanic and got her my pricing.  I really could not do anything more.
