Hansen And Horn Home Builders ripoff, mortgage scams, stolen earnest money, Indianapolis Indiana

In June 2006 I made an offer on a home on the south side. The price od the home was at the top of my limit so I had written in my offer that I had to find a mortgage of 9% or less or the agreement would be null and void. Hansen and Horn Builders made a counter offer as far as cost but accepted the contingency of the intrest rate.

They offered me a mortgage broker that they said worked with them on a regular basis. I took the card but was leary of working with a broker associated with the builders because i've heard all the horror stories about people getting mortgages and then losing their homes.

I was refinancing another home i owned, so i felt it would be much easier to work with that company since they already had all of my financial information. When the gentleman came to my home for me to sign the refinance papers he informed me that the lowest rate he could get for me on that price home with no money down was 9.74%. at this rate my house payment would be a staggering $2500.00 per month, and I knew this was just too high a mortgage for me. I talked to my realtor who asked me if i had talked to the broker that Hansen and Horn had suggested, and I told her no.

The same day the Broker that worked with Hansen and Horn called me. I told him that I was already working with a mortgage company and told him what they had told me about the rate. He began to ask me some questions and i answered them. He said he would see what he could do. He asked me if he could look up my credit score and how long i'd been on my job, and how much money i made.

I NEVER filled out an application with him but he said he could probably get me a pretty low rate IF I rented both of my houses out. I contacted Hansen and Horn right away and let them know what the mortgage company I was working with said about my rate. The salesman who was originally very nice became very rude to both myself and my realtor.

The salesman did finally give me a release for the return of my earnest money(without signing it) abouth 5 days after I recieved a letter from their attorney stating that they intended to keep my $1000.00,+ $2,500.00 + $100.00 per day until I closed. They stated that the broker that they referred me to was able to obtain the loan at 7.25% and that I owed them the money. I am still trying to get my money back.

They have refused to speake with my realtors firm and now i am faced with eithe a lawsuit of the high cost of an attorney.
