Hatam Restaurant They overcharged a catering order. Mission Viejo California

The food was good but it's very unfortunate that they are very dishonest when it comes to business. If you ever decide to do a cater by them, make sure you get all the orders in writing. I visited the restaurant a few weeks before my kids' birthday party to discuss the menu and gave a rough estimate of 40 people. She told me that I can always text message her to modify the order up to the day before the event, whether it's the amount of people or food choice. I texted her 3 days prior to the even to change the order to 30. She didn't reply so I called her the next day and told her I had to decrease the order by 10 people since less people than expected could make it to the party. We reviewed the order, she gave me the final price and then we hung up the phone.

Came the day of the party, I was rushing to get decorations set up while the delivery guys came. He handed me the credit card bill and I signed for it. It wasn't until AFTER the party that I realized that Hatam had charged me for 40 orders instead of the updated amount. I text messaged the boss lady and left voicemail messages for a week and she finally returned my call. She realized what happened and admitted fault but said she was unable to do a refund for the difference in payment. She offered to give me food for the amount she owes me.

I didn't understand why she couldn't do a refund. She said she would check with the credit card company and I'm doubtful she really did. So, I called my credit card company and they recommended to start a dispute. Well, I did and the restaurant wrote back to the credit card company saying they have no idea why I am disputing the amount. WHAT A LIAR!!! THEY KNOW WHY! BOSS LADY ADMITTED FAULT AND OFFERED TO REPAY ME THE AMOUNT IN FOOD! Unfortunately my Chase credit card said that text messages are not valid evidence so they couldn't ask the merchant to do a refund. Argh! I learned my lesson. Get everything in writing and don't get ripped off!
