Last year I failed to update my credit card with HCTRA. During this time I also moved.  To be honest HCTRA didn't even cross my mind at the time.  One day, maybe a couple of months after I moved, I was stopped by the constables that are always sitting on the side of the EZ Tag lanes, I wondered why this happened, I was not speeding, I have insurance, I don't owe any tickets, a thousand thoughts came through my head in one instant.  The cop then informed me that I owed almost $3400 in unpaid toll violations and fees!!! He said that he should arrest me, but he was going to be nice and give me a pass but that I needed to take care of this problem but he gave me a ticket for driving in an unauthorized lane. I live far from work and each day I use the EZ tag 3 times in the morning and 3 times in the evening, for a total of $14/day.  I called HCTRA and they told me that the total of my actual tolls was less than $400 but that the whole amount of almost $3400 was due and needed to be paid right then and there. I could have my registration revoked, my license suspended, and I could go to jail if I didn't.  Unfortunately, I did not have $3400 sitting around and could not pay.  They were not negotiating their fees either, it was pay it all or suffer the consequences. I decided I was going to challenge it at the hearing for my ticket. I called the court and set it for Jury Trial.  In between this time I called to update my credit card again because I lost it or something and while on the phone with HCTRA they informed me that my file had been sent to thier counsel Lineberger Goggan Blair & Simpson LLP that handles these matters. They had already held a hearing in their own court and filed a judment against me for unpaid tolls, violation charges, collection charges and attorneys fees in the amount of $4800 and change!

This has been a nightmare and here are some of the issues I have with the way they have their set-up:

1.  There are no checks and balances within the organization: They get to charge you whatever they want and that's it. They state how much the tolls are, they state how much the fees are, how much any additional fees are and there is no negotiating or anyone to hold them accountable for their increases.  Its about the money, nothing else, there is no customer service whatsoever, there is no trying to work with you. 

2. There are no limits to their reach: It is my understanding that they are in a Public Private Partnership between the toll owners and Harris County.  The toll owners "lease" the land from the government and in turn pay a fee. But their reach does not end there, it seems that they also have access to public funding entities, like the Harris County Constables as I found out in my particular case. From the little that I read, Harris County has a 50 year contract with the toll owners. So we're in it for the long haul.

3. The owners of the Tolls have a monopoly in this system. There is no one to compete with them, therefore, there is no one offering better pricing which causes them to not have any desire to "work" with their customers. So basically we're screwed, you pay or else...

4. They even have their own hearing board.  My plan was to show up at the "trial" for the ticket and dispute it, I was hoping to at least get some of the fees taken off so that I could pay it. It turns out that even before my ticket trail happened, they scheduled their own hearing in their own administration (YES THEY CAN DO THAT). I didn't get notice because they still sent it to my old address, even after I updated it and since I did not show up they filed a JUDGEMENT against me. 

5. Guess who sits on the hearing board? Harris County Officials. Who gets a cut out of any money from the Toll Owners? You guessed right, HARRIS COUNTY. In this hearing the Judge has the option to assess additional fines and costs, flag (block) the vehicle registration, or place a device (boot) on the vehicle prohibiting movement until the outstanding tolls and fees are paid. This could end with you in jail and/or with your license suspended. There are no checks and balances. How can you expect to get a fair trial or hearing or outcome when 1) the entity you are challenging has its own set of rules;  2) the hearing board is composed of people from the entity you are challenging; and 3) You just can't win.

6. You lose (in this case I did). There's no winning in this situation. I ended up being able to make a payment plan to pay almost the $5000 back in a ten month period after the Judgment was entered. I am paying over $400 every month, because well the alternative is not an option for me but it is extremely frustrating that there is no way to fight back, no way to get them to care.

 I do Agree that This Toll Company And More Make up Their own Laws, Set their Own prices . An Have no Customer Service. As well The Local And State Government Backs them Up . There Is so Much "Grift " Involved From the County Commissioners city managers And other City And State Government Employees. It is a total rip off.   The Only Issue i have with your Statements is that I find it hard to believe that the Whole time you were running up that Big Bill. You didn't receive One Statement, Phone Call , or Lack of Charge to your credit  card to let you know something was A miss . They Are Definite CROOKs- In my case I disregarded the Notices until 4 tolls Became $125. a year later.

 I had an ez tag and had forgotten to switch my cc info. I used the tolls daily, and when finally notified, I had ran $112.00 in tolls, but with the fees it totalled much more. After failing to reach and agreement in fees, their law firm filed a judement. I tried calling the firm multiple times, but they would never return my calls. Now I owe $1900.00 for those tolls. I recently sold my vehicle. The new owner called me, weeks after the sale to tell me he could not register the car and they are trying to GET HIM to pay them. That is ridiculous. I am interested in a class action as well.

Similar Situation with HCTRA

Hi there, I was hoping anybody could provide further insight on this issue. I'm just now finding out that I am in a very similar situation to the ones previously described. It turns out that I owe them up to $1,600 in fines. Long story short, I did not have a credit card linked to my account because they require you to have up to $40 dollars in it at all times. Because I hardly use the toll, that seemed like an excessive amount of money to have on this account (I am a student so every penny counts for me). Everytime I would use the tollway I would make small payments of $20, $15, etc. However, sometimes my account would go below by $1, or $2, at which time I would log on to their onlne system and make an online payment. But everytime I went through one of the EZ tag checkpoints and I was under a negative balance a violation was commited.

According to the HCTRA agency, they mailed all violations to my old address, and they also (supposedly) tried to contact me via email. I went through my inbox and spam folder only to find nothing. Therefore, months went by without me even knowing that I had commited such violations, therefore the violation rates incresed and I continued using the EZ tag by making small payments. 

I understand that violations were commited. However, I feel as if the agency made no real effort to contact me in order to prevent further violations or to try to collect their money. Instead, they let months pass by so they could be able to send such debts to a third party "Lineberger Law Firm" I still cannot understand why I didn't  revceive ONE single letter notifying me of the violations to my MAILING address. What is the purpose of having a mailing address if they won't mail me documents of such importance? 

I spent hours on the phone trying to make them understand that these charges were unfair and that I would gladly try to work out a deal with them if only they would provide me with a reasonable amount. All of my efforts were to no avail. They only solution they provided was for me to make a payment plan were I would give them a 20% downpayment and then the rest of the money over a period of 5 months. 

Do you guys believe seeking legal counsel would benefit me?

Issues with HCTRA

I am also in a similar circumstance.  I had two instances in the past where my credit card had expired and HCTRA started sending me invoices for toll violations.  I called the number on the invoice and was appalled that my total due was over $400 each time.  To my surprise they simply asked that I pay the toll fee and they would waive my violation fees. 

Most recently, I had another issue with my credit card and I started receiving letters in the mail.  After the first letter I tried to call them and was met with a recording saying that my wait time was 30 minutes.  I did not have time to wait on the phone for 30 minutes so I hung up the phone.  I waited another week and tried to call again and once again I received a message saying that my wait time was over 25 minutes.  So I hung up and waited another week.  Based on my prior experience, I thought that it was no big deal because they waived the fees in the past with no problems.  The following week I decided to painfully wait the 25 minutes for my call to be answered.  To my surprise, I had over $1,500 due to them.  I assumed they would waive the fines and let me bring my account current, but to my surprise the answer was no.  They sent me to the enforcement division where I waited another 30 minutes for my call to be answered.  Again, I was told that my fees could not be waived. 

This is very frustrating because if I could have got in touch with them three weeks ago I would not have near the balance due.  Additionally, they do not put a total amount due on their invoices so you have no idea how big the fine really is.  This organization is structured very badly.  Please let me know if there is a class action lawsuit in process, I would be glad to join.

Get accused of running a Harris County Toll, and Terri Hall says watch out..

"The deck is stacked against the citizen,” Hall said.

She's a grassroots community organizer who says when it comes to fighting violations from HCTRA, the Harris County Toll Road Authority: "You're guilty until you prove yourself innocent."

Case in point—Lisa Bowen.

"They got the wrong name, the wrong tag number and the wrong car,” Bowen said.

That's right. The violation notice from HCTRA is one digit off from Bowen's actual license plate. While she can try to dispute it over the phone, Bowen and others only get their day in court after the toll road authority sends their violation to a collections firm, Linebarger Goggan Blair and Sampson. And once you get to court, the same firm after your money also is the law firm representing Harris County against you.

"Everything is backwards about the way the system works,” Hall said.

"It's kind of like the fox in the henhouse," said motorist Gabe Mosqueda.

Mosqueda said with that kind of set-up, he doesn't stand a fighting chance. The longtime toll user claims HCTRA sent at least some of his violation notices to a wrong address. The amount owed shot up: $231 dollars in unpaid tolls and $600 dollars in fees.
    
And the judge hearing his case is paid by the Toll Road Authority.
  
“It's just a huge conflict of interest there, it doesn't make any sense," Mosqueda said.

Turns out, HCTRA almost always wins and the motorist loses. The I-Team checked three years of toll hearing records, and the Toll Road Authority prevailed 95 percent of the time.

So we asked HCTRA Spokesman Adam Collett:

I-Team: "Do you see anything wrong with the collections firm also fighting the case for the county?”

Collett: “I'm not in a position to give an opinion on that.”

I-Team: “Does the Toll road Authority believe that the hearing process is even, level?”

Collett: “The overall system is…”

I-Team: “That's not the question, the hearing process, customers say it’s one-sided.”

Collett: “Well I'm sorry, again, I just don't have an opinion for you on that.”

And the Linebarger law and collections firm declined our on camera interview request, but sent the following statement:

“It is entirely appropriate to levy reasonable fees against individuals who do not pay tolls for the use of Harris County toll roads. The vast majority of toll road users pay their tolls and it is unfair to ask them to subsidize those who fail to abide by the law.  As legal counsel for the Harris County Toll Road authority, it is our job to advocate on behalf of the county in order to collect past due tolls and fees and when we do the full amount is paid to the toll road authority.  The law firm collects a fee for its services that does not reduce the amount that we recover for the taxpayers of Harris County.  The fact that the vast majority of those fines are upheld when brought before an administrative law judge, coupled with the fact that the majority of those appealed to the county-courts-at law are also upheld, is evidence that the system is fair and effective.”

But don't tell that to watchdog Terri Hall.

"Oh no, no, no, wait a minute, stop,” Hall said. "You don't have a prayer of having a true impartial case.”

After the I-Team made the Toll Authority aware of Lisa Bowen’s case, HCTRA says it cleared her of the violations that she had been accused of and deleted the resulting toll and fees she supposedly owed. In the case of Gabe Mosqueda, HCTRA waived more than $1500 in fees on his two vehicles and settled his case."

I have read many complaints that are similar in nature. It may be a good idea for us to come together and file a class action lawsuit against HCTRA and Linebarger. Respond if you're interested.
