I recently used a Help-U-Sell Agent, Victoria Addison, to purchase a new home. One incentive to use her is that their literature states that their commission is set at 2% so "any fee over 2% is credited back" to the buyer to help with the down payment or other expenses at closing.

This is in writing and all over all of the advertisements and information in the packet she gave to me along with a copy of my realtor agreement.

While she was my realtor, she had someone else show me homes, I had to drive myself and other realtor on many occassions, she had me go onto a property unescorted, she didn't know what a 203 K loan was and kept calling it a 401 k, She did not prepare contracts in a timely manner and I lost a bid on a home, she encouraged me to add on incentive money to a buyer in this market, she discussed my finances without my knowledge, she had a loan company run my credit again to obtain a new pre-approval letter, I almost lost the contract on the home I purchased because she didn't know how to handle foreclosures, I had to do most of the legwork on this deal because she kept dropping the ball and the other realtor's office no longer wanted to deal with her... and the list goes on.

Anyway, after all of this, I got to settlement! At that time I expected the 1% of the commission as promised in the literature she gave me. She said that I was incorrect and that I signed a document stating that I am to receive .05% or $500.00. What? Apparently, I did sign the document but didn't read it since she just said to sign here as part of the contract. I had to request a copy in order to see if it was true.

Since that time, she gave me a check for .05% with a note on it that states I have no recourse if I sign it. I haven't signed it yet.

she will not answer me when I ask why her literature that is personalized with her business name and address does not relflect a return of .05% to match her waiver? Why would she give me documents that say I get 1% and then have me sign something agreeing that I am to accept .05%.

she told me I should feel lucky to get that. I am writing this because it is a horrible feeling to be duped. I hate it that I trusted her to be honest and have integrity.

Unfortunately, it is hard to make a grievance against realtors and ethics is a fine line. It is also unfortunate that she can do this to someone else. I am hoping that this will get to as many people as possible and she is asked to explain.

Since I wrote this report, Victoria contacted me via e-mail and stated that the materials that were in my packet were incorrect and out-dated but she will now honor the marketing advertisements and give me the fee quoted in the marketing materials.

This is after submitting a grievance to her and faxing her a copy of the materials she gave me in my Help-U-Sell packet. I am not sure if this is what gave her a change of heart or if it is because I said I would use other resources to inform consumers about signing contracts with her and Help-U-Sell.

All in all, she says she is forwarding me the rest of the payment I should of received at settlement.
