I was parked in a private garage where I pay $150/month for an assigned space. They somehow entered the garage around 2:30am and towed my car, allegedly for not having a permit which I do in fact have and they could have seen had they bothered to look.

I was charged $128 including a storage fee (for less than 24 hours in their yard) and a mileage fee.

  1. It is now illegal under MD state law, superseding Montgomery County law to tow a vehicle without specific authorization from the parking lot owner.  They are not allowed to use a contract with the lot to come find cars to tow wihout being specifically authorized MD Code: Transportation: 21-10A-04
  2. If the building authorized the tow, they would have been required to check against their records to confirm I was not authorized to park there.  I pay for a monthly permit and they had my vehicle tag and make/model on file.
  3. Building management does not have office hours at 2:30am so I do not think they authorized a tow of my vehicle.
  4. If they were not specifically authorized to tow my vehicle, then they were trespassing in a private locked garage in the middle of the night. 
  5. The building did not post legally required towing notices in the lot as required by law. 

Under the new MD law (2012 and 2013), police are required to issue a criminal summons to the towing company for violations of 21-10A so I will be following up with a criminal complaint and a complaint to the office of Consumer Protection in Mongtomery County who btw have 98 complaints on file against this company, 71 which are listed as "unresolved" and 4 more pending. 

This is far more complaints than any other towing company I see listed on that site

I confirmed with the on-duty staff at the building that they did not authorize a tow at that time of night.  This should give me enough to make a criminal complaint. I also did some research and these guys have roughyl 100 civil lawsuits listing them as defendants in MD courts over the last few years. If anyone is ripe for a criminal investigation it is these guys.
