To Hertz Claim #: 256021                                          LETTER OF DEMAND/Without Prejudice

I am disturbed that you have made an accusation that I have handed back my Hertz Rental Vehicle with more damage on the car,than when I picked the car up.

 

This is a lie and I will prove so in Court if necessary. I am a person of integrity. I have never had any kind of Insurance Claim, nor lost points off my Licence. My personal  Vehicle a VW Golf, and is unmarked after 3 years of use. No minor marks nor bumper damage.

I am a very careful Driver.

 

I relied on Hertz being a Company of Integrity when I rented a vehicle that had minor damage: not to be held accountable for damage that I did not incur, and I am incensed by your false accusation, and the holding of $3686 of Funds from my Credit Card.

 

Your Company inspected the car on Pick Up and Arrival back after a 3 Hour Rental.I have a Report when I picked the car up, showing very minor marks on the front bumper bar consistent with small scratches. This was pre-existing damage to your vehicle from when I received the car on Monday morning, drove to Caringbah for a Meeting and returned the car to you, with no other damage or marks,3 hours later.

 

Today I received a notice from your Claims Department that I had incurred damage to the car and my Credit Card was charged to cover this damage. Let us be very clear. There was NO FURTHER DAMAGE Other than what already existed as marked in my Rental Agreement at time of pick Up. Copy available. I am aware from my Credit Card Providers’ Commonwealth Bank, that Hertz has taken a charge over my Credit Card of  $3686. There is also an extra Overcharge for the Basic rental of $107 which is an extra $80 Billed.

This was supposed to be $107.

When I queried this charge of $3686, Agi in your Claims Department, said it was being reversed immediately, and Daniel in Customer Service said he had been aware of this and was sending a Fax release to my Bank Cards Department that day, Wednesday afternoon.

 

On examining my Bank Cards Statement this morning, no charges had been reversed.

 

I dispute this was damage caused by myself, and demand all monies held by Hertz, other than the Rental Charge of $107.00 are released, immediately, or my Solicitors will act according to my instructions, to have Hertz repay the amount charged $1105.70 plus Interest, and Legal Fees.
