To whom it May Concern:
I was in the market for a car after mine was totaled in an accident. I was married for 21 years and EVERYTHING was in my husbands name. On October 25, 2016, I went to a car dearlership to test drive an advertised 2016 Kia Soul for $9,999. After finding the car on the lot and test driving it, I was told that the advertised car for $9,999 was no longer available (typical bait and switch). I told the salesman, Robert White, that I did not believe that I would get financing. He then assured me that I should be eligible for the First Time Buyers loan. I wanted to leave when I was stopped and told by Mr. White that a car was just brought in a few days earlier. It ws priced below what it was worth and that it was a gem!!
I test drove the 2008 VW Beetle. I asked what the price was and was told, don't worry about it. As the dealing started, a man came out with a piece of paper folded up with a monthly payment price of over $380/month. I said No. He returned with a little lower payment, $368. I said no. This continued for over an hour. Finally, the payment went down to $238/month. And I said yes if they could get me the financing. Mr. White left to speak with the financial manager, Nissa Juarez. He returned and said, "Good news!" "we were able to get you a loan as a first time buyer. Robert White the walked me to the financial office wher I would be signing the papers with Nissa Juarez.
The price of the car was $6576. Then Nissa Juarez added on a 2 year warranty for $2994. When I asked her to take it off, she told me that the people who were financing me were requiring it. After 4 hours, I finally left for home with the car. The next day, October 26,2016, Sunday, I drove to the dealership and gave Nissa a check for the down payment in the amount of $1500. I also asked her why the financing was so high, 17.99%. She told me that the company that IS financing me is being "kind of hard" on me and they want to make sure they are making a good investment.
I felt as if I had no choice and Ms. Juarez knew how desperate I was to start my life over after my husband left my daughter and I to be with a stripper. I drove the car for approximately 2 weeks before I got a phone call stating I had to come back in and sign more papers. I've bought several cars in my lifetime and this has never happend. I looked it up online and apparently this is called a "Spot Delivery Scam." A dealer tells you youre approved for financing and then they call you back and tell you it fell through. They then hold your car for ransom as they demand a higher down payment and/or a co signer. In my case they told me to bring the car back because I told them I'm not getting a co-signer nor am I giving them a higher down payment because NISSA JUAREZ outright lied to me and told me that I HAD FINANCING! AFTER I was allegedly decline for financing, NISSA JUAREZ CASHED MY DOWN PAYMENT CHECK!!!! She had No Right to cash a check for a car that I was not buying!!!
At the advise of my lawyer, I requested from Nissa Juarez, a letter from the financers outling the particulars as to why I was being declined and what they needed. If a bigger down payment was needed, I wanted Nissa Juarez to remove enirely, the warranty she was forcing me to buy for $2495.00. I believe she was not practicing ethically which explains why she did not try to call me or email me. I no longer had any trust in Nissa Juarez, so after I hadn't heard from her, I returned the car in the exact condition I picked it up in except it had gas and now Nissa is refusing to return my check. ISN'T IT CALLED THEFT WHEN SOMEONE WONT RETURN YOUR MONEY???? I just want my $1500 back so that I can purchase another car, go to work everyday and support my daughter.

To Monique, Nissa is correct. sometimes on a pre owned car the fince company will require a warranty to protect their investment. VW only has 3 yr 36 k miles of warranty. the finance company is protecting the investment to make sure if the car breaks down that buyer wont just park it and leave the car to be reposssesed in turn losing money for them and making it harder for the buyer to buy again. Nissa is very good at her finance.
she has worked car deals for me when the customer was in a tight spot and between working with the customer and the lenders they put it together. of course the dealership is in business to make money however they are also in the business to earn a repeat customer. there are some shady pealers out there but i can promise that the GM of that store wouldnt let something bad happen that would allow the managers and the reputation of the store be damaged. Have faith and it will happen for the better.

It is very apparent that you have never purchased a vehicle by yourself based on all of your actions.
I don't work for the dealer at all and what they did is unethical, but entirely predictable.
They saw you coming. That is why they offered you this "First Time buyer" program - code for rip off. They know you are not aware of all the tricks dealers play so these "first-time buyer" programs are designed to maximize dealer profit -
There is a right way to buy a vehicle and a wrong way. The right way is to do all of your research first, get approved through your bank or credit union, find the vehicles(s) that work best for you online, negotiate via email until you have a few (2 or 3) vehicles to test drive. Once you find the vehicle you want, you have a third party professional mechanic inspect the vehicle before you purchase it (pre-purchase inspection). Then you read the contract to make sure it follows the terms you already negotiated via email .
The very last thing you do is go into a dealership and you never let them run financing for you as they will do as they did to you.
What were the red flags? See below:
- Advertising a vehicle they did not have is a big red flag -
- Showing you a much older vehicle that was "priced below its worth"
- Saying that the finance co requires a warranty - this is outright fraud as the standard vehicle purchase contract has a boxed area that states vehicle warranties are optional. Once a finance or sales person tells you it is mandatory, it is time to run away from the dealership
- Not quoting you a price is a huge red flag - they were selling you on monthly payments which is the worst way to buy a vehicle
- The spot delivery scam is another one - you picked up on that but you had been put through your paces already.
The best thing to do is to research online how to buy a vehicle before you attempt again. NEVER go to a dealership 'cold'. NEVER go to a dealership without having your financing in hand before you step foot in the door. Become an educated consumer - which is the dealerships worst nightmare :)
