The website operated by this company falsely creates the impression that you are dealing with a gift shop / florist that is affiliated with and co-located with the hospital where you want to have a gift or floral arrangement delivered.  In fact, Hospital Gift Shop and/or Healthy Commerce, Inc is just an order processing office with 4 employees operating near San Diego, California.  The orders actually will be fulfilled by some other business located in the vicinity of the delivery address.

The website operated by this company falsely creates the impression that your order will be delivered to the patient's bedside on the same day.  In fact, same day delivery is made only Monday through Friday, if the order is placed before 1:00PM local time.

I feel this is fraudulent misrepresentation.  The website is set up such that if you do a Google search for a giftshop at some specific hospital, such as:

memorial hermann hospital gift shop

one of the top search results will be:

Send Gifts and Flowers to Memorial Hermann ... - Hospital Gift Shop

This link takes you to the Hospital Gift Shop website.  The banner at the top of the page proclaims:

SAME-DAY BEDSIDE DELIVERY

Just below that is the statement:

Same Day Delivery to: Memorial Hermann Hospital Houston, TX

If you read the fine print, the website does admit that Hospital Gift Shop is not affiliated with the hospital.  They also admit that same day service has limitations.  So technically, they are not legally fraudulent.  But the website clearly makes every effort to mislead customers.

I ordered flowers at about 1:00PM Houston time on Saturday, 8 April.  My order confirmation read:

DELIVERY DATE:
Saturday, April 08, 2017

However, reading further down in the confirmation, I also found:

All gifts are delivered to the appropriate custodian at the hospital. Depending on the facility, this may be the front desk, the flower room, the volunteer office, the hospital gift shop or another designated custodian. Orders are then delivered by the hospital's staff to the patient's bedside.

And:

All floral, balloon and plant arrangements are prepared and delivered on the same day if ordered Monday thru Friday before 1pm in the recipient's time zone.

That is when I went back to the Hospital Gift Shop website and started reading the fine print.

My order was never delivered.  I cancelled it Monday about noon.

Don't do business with these people.  They are just a bunch of crooks.
