I made and paid for a car rental reservation May 27 reserved for for June 1 at 12 noon.

June 1, 2009 (12 noon), I arrived at airport (Hertz) they did not have a car ready.
I was told I would have to wait until a car was turned in, a possible 2 hour wait.
I told Hertz I  had timed travel plans and could not wait, I did not rent a car, because they did not have a car available.

Called Capital One within the hour, and told them to reverse the charge for reservation. They did so.

I called Hotwire, "they said all sales are final" no refunds, they stated I was the one that left, instead of waiting for a car to be turned in."
I stated "there was not a car available at the time I needed it, so therefore I could not rent a car."
Hotwire, stated " that is our position, all sales are final."

Capital one after 90 days (Aug. 27 ) rebilled my account for $172.61 Capital One stated I needed a credit from Hotwire in order to refund the charge, and since it has been 90 days, they consider this dispute closed.

In order to get my money back I would have to take a flight to San Francisco and file suit in small claims court. It would cost me about $500 for the air fare.

So Hotwire and Capital One in collusion, basically stole $172.61 from me.

I repeat Hertz did not have a car waiting on reservation,
I did not  or pick up a rental car, there was not a car to pick.
Hotwire would not give me a refund, and Capital One would not credit my account.
Hertz, states this dispute is between, Hotwire and you and your credit card company. we did not charge you.

I have closed My Capital One account, and refuse to pay the amount out of principle. Yes, it will hurt my credit rating...Yes it will only hurt me, but I will feel better knowing they have one less customer they can ripp off.  They can charge me for a ripp off, does not mean they can make me pay.

Buyers beware.
