After loosing a house to foreclosure in 2009 after my intrest rate adjusted and the market crashed I was in debt up to my ears. Most of my creditors worked with me to take pay offs of about 20% of the debt I owed. Howard Lee Schiff took on a debt I owed and sent me a few letters, I called each time and explained I wanted to avoid bankrupcty and would pay a similar payoff that my other debtors took, Howard Lee Schiff denied payoffs of a lesser amount and opened a court case against me. I then sent a certified letter to Howard Lee Schiff offering a reduced payoff and called them. On the phone I was told to just wait a while and once some time passed they would be more likely to take a lesser amount. I never heard of a court date, not knowing the laws at the time, that there was never a court date. I should of known magically to file documents with the court answering this case, and since I only communicated with Howard Lee Schiff directly, they were able to win a default judgment against me, claiming I had no contact with them, since I didn't file it in the court! Dirty money hungry lawyers using tricks they learned in law school to hide behind a pile of paperwork and screw a average guy that is attempting to pay off his debt. The attorney general should look into the tactics these pricks use. Oh wait this is RI, Howard Lee Schiff's staff is most likely married to half the staff of the AG's office.

I filed my answer on the date provided in person to the court in Wakefield. I drove to Providence to file in person at the Attorney's office. The secretary took my paperwork and then offered to explain the account to me. Her explanation was generic same as paperwork.
In my answer to the court I requested Discovery of Documents. Specifically documents with my signature on a binding contract.
I received a packet of generic papers Notice of New Ownershipe And Pre-Legal Review. Which is a standard paragraph form paper with my name typed at the top asking me to pay a company in LA.
I received in another letter a Portfolio # MCM account (Midland a company I have never entered into a contractural agreement with) and Documents billofsale, chainoftitle. LMAO
The "Bill of Sale" could be typed on any computer with a Logo from google for GE at the top left. The value is "redacted". The chain of title is:

Our hearing was April 21 but I received a letter they sent to the court requesting a change in dates to May 19th. I am on vacation May 18-22nd. Plane tickets already bought. I sent a rebuttal to the court explaining that they have been pursueing this according to their paperwork for almost 1 year. They should not be sueing people without proper proof in the first place. I request to be seen in court on our original date as I am ready to defend myself and I am unavailable on the 19th of May.
Mailing out tomorrow am! Let's see what happens next.

I have never even heard of Howward Lee Schiff before until today, when I was served with papers from this firm claiming that they had placed a judgment on me back in 2011 and claim that I owe them $545 and want me to go to court in a month! First of all, all this fuss over a measly $545??? Really??? Secondly, I have no idea who these people even are, nor have I ever heard of such a judgment being filed against me. If there was really a judgement that has been there for 3 years, you would think I'd know about it! I have never been served with anything before in my entire life and I've never even heard of these people. I've been wracking my brain trying to figure out what in the world this could possibly be about, but I can't think of anything at all. I always pay my mortgage, car payments, and other bills on time. Even the guy who served me with the papers agreed that it was probably something completely ridiculous and that it was most likey some horrible collection agency. Of course, I just got this at almost 6 p.m. on a Friday evening, so now I have to wait until Monday to call them during normal business hours and find out who in the heck these people are and why they are bothering me. When I Googled Howard Lee Schiff to find out exactly who they are, the first page that came up was Ripoff Report, so I have a feeling these people are a bunch of scumbag attorney wannabes or attorneys who weren't good enough to be hired by a real law firm. I'm very anxious to find out what this is all about. This all came out of nowhere. This should be interesting!
