HSBC Retail Services, - Household Financial, - Household Retail Services, illegally repossessed motorcycle and returned damaged Carol Stream Illinois
I called Household and we both then realized that the collector I spoke to put my payments on the wrong account. I had not recieved a cure letter, even though they said they sent one. They explained that I would still have to bring my account current, but they couldn't take the payment off the credit card account to put on the motorcycle account. I was told I had to make those payments again plus another payment to bring the account current, then they would release the bike to us. They dropped all fees, including the late fees, repo fees, and storage fees (1 day).
I immediately sent them the payments through Western Union, and was told the Repo company would bring the motorcycle back, but it would be in the middle of the night because they didn't have the "manpower" to bring it back during the day. I decided to pick the bike up myself, and when I arrived there I saw they had damaged the bike. I found the bike sitting out in the rain in a huge mud hole. It had huge scratches on the front fender (down to the metal) as if they ran into something with it. The tank had large scuffs (that won't come off) from the straps they used to transport it. There were at least 10 guys standing around doing nothing who could have brought the bike back to us, but I figured they wanted to wait until dark so I wouldn't see the damage! The bike was new with only 1k miles on it. It was garage kept and immaculate before they picked it up. I complained to the finance company, and was told to contact the repo company, who in turn told me to get an estimate while they decide whether they are liable or not.
This was a humiliating experience. Not knowing what to do, I turned the keys over to the repossessor (thinking he would take care of the bike if I did), and they treated my 1500 Suzuki Intruder like a dirt-bike! It was the middle of the night and the repo-man banged on my door and told me I had no choice but to give him the motorcycle.
What, if any, rights do I have against the finance company or the repossession company?
