I Heart Resale- Consignment store Gave the run-around when I asked to pay me and now they're saying that it has been past 90 days so they won't pay. Also refuse to give unsold items back. Houston Texas

I encountered this business and its owner Lyra in July, 2015. I left a lot of my designer purses, belts and clothes to be sold. I checked on the status regularly. First the owner said that although some items have been sold, there wasn't enough money to write a check and that she would write once it is above the minimum amount. The next time she said that I have over minimum amount and said "I'll write it out to you at te end of the month and mail it". I keep calling the store but the Lyra lady is not to be found. 2 months later, I still haven't received the check and call the store and then visit. The girl at the store (ashley) says that since I didn't pick it up in time, it went back to the store account and she can't give me anything.
I asked if I can pick up my unsold stuff but she said that I'd have to go around the store and find them. There is no way anyone can do it because 1. I don't know how they organize their merchandise and 2. for all I know, it might be in storage or at their home. I tried to resolve it with Lyra and she says that the stuff now belongs to the store. First off, they price expensive purses cheaper than dirt without telling/consulting or even notifying the owner. Second, they have a "policy" to never call anyone whether to pick a check or to pick up stuff or even to say that things have sold. So, basically these horrendous people stole my money and stuff and I hope she goes broke as karma is a b****.

You can be as vindictive and threaten me with bad reviews and police reports as much as you want but the fact remains that if you signed a contract as an adult, you must also honor that contract as an adult. All the bad reviews you leave and the tantrums and hissy fits you throw at our store ruining other customer’s experience is not going to change that.
As a consignment store, we provide an avenue for people to sell and make a little cash out of items they use to love but no longer want. We encourage our consignors to bring only items they were thinking of getting rid of but are still in good sellable condition.
As per the contract that you have signed in July, pricing is our discretion and we price items based on its condition and market value. You signed the contract and left items for consignment thus agreeing to those terms. A retail value for a coach purse maybe around $300 when it was in season and brand new but the purse you brought in are already all beat up and used up so there is no way the bags will sell over a $100. Also a knockoff Louis Vuitton bag that is already disintegrating will not sell for that much. The shoes you brought in even though they maybe designer/brand name items were falling apart and we told you then we will not accept it for consignment but you left them at the store anyway and you said to do with it what we see fit so we threw it away as we do not even see it fit to be donated to goodwill.
As per the contract that you have signed and agreed to in July, consignors are responsible for keeping up to date with their consignments. Consignors are responsible to call if they want status on their consignments. We have thousands of consignors on both our stores and we would rather efficiently use our employee’s time on taking care of customers that are at the store than to spend their time making phone calls.
As per the contract that you have signed and agreed to in July, consignors are responsible for picking out their items from the rack should they choose to take it back at the end of their consignment period.
As per the contract that you have signed and agreed to in July, we will consign your items for 70 days and you will have 7 days the consignment periods end to pick up what does not sell. Items not picked up will be considered abandoned and will become store’s property. We will dispose of it as we see fit. It was your responsibility to pick up your items in a timely manner. Our store will not serve as a storage for items you were trying to get rid of in the first place at our expense.
We’ve given you consideration and extended you consignment one more round. The last time you followed up is on October and I have told you then I will write you a check, not mail you the check. As per the contract you signed checks must be picked up within 90 days of it being issued or it will be voided. You came in after almost 5 months.
