I recently received a summons and complaint from Seth L. Goldner in Michigan, via Independence Receivables Corp for a Bally's Total Fitness account from 2008. I signed up for a Bally's Fitness membership in 2008, for what I was told was a month-to-month membership that I could cancle at anytime for $50. I used the gym once and a month later went to cancel and they told me that I couldn't cancel my membership, the club member who told me I could and signed me up no longer works there and to contact their corporate office. I did this several times with no response, mailed them a letter, with no response and just sort of forgot about it.
I get served with a summons and complaint from this company Independence Receivables Corp c/o Seth L. Goldner and I have never heard of them before. I call Goldner's office to see what it's about and they say it's the Bally's Total Fitness membership I never paid. I tried to explain how I was tricked and the membership was misrepresented - a trick Bally's is notoroiou for, but he didn't care, he said we are sueing you for $1275, unless I want to pay them $550 now.
I told Goldner I wanted to contacte Independence Receivables Corp and he didn't want to give me their number, so I googled it and there is a train of scams in cons associated with them. They are what is called a junk-debt buyer, they buy old debt for penny's from companies that long since closed and written off accounts. I told them they didn't know who they were and they said Bally's sold them my account, but first they passed it to iQor, and Allied Insterstate. My closed and written off Bally's account has been passed around for years, and now they are trying to collect on a membership I tried to cancel and never used.
I visited the Bally's center in Novi, Michigan (where I originally signed up) and the manager told me that my account had been closed and charged off since January 1, 2009 and that any money I pay them will never go to Bally's. I expressed my frustration and advised that I will sue Bally's and he said Bally's has nothing to do with this suit, however, I do not have a contract with Independence Receivables Corp, so the contract they are collecting on is not theirs. He told me I would have to summons the records from Bally's stating that my account has been charged off since 1-1-2009 and take that to court.
If you are face with a situation similar to this - do not pay Independence Receivables Corp or any of this rip-off debt collectors. Answer the court denying their accusations. They will send a notice to the sueing parties informing them you are fighting it. They have the burden of proof that YOU owe THEM money and they have to have a transaction log of all the companies that have had your contract and debt, which they will not have as well as the fact that your account has been closed from the original cliet that you have the contract with.
These companies try to collect on old written-off debts that have been closed for years, trying to pinch what they can from you, to later have your account resold by another, showing no proof of payment and comping at you again. It's fruad at it's best and most of them involved are small attorney offices. When I called the first number for Independence Receivables Corp I got Laurence Abramson's office and the receptionist wanted to know why I am calling and how I got the number and she paused and seemed surprised that I found them because she knew good and well that the number they have listed for Independence Receivables Corp is disconnected. They never want you to reach them, they just want you to pay them for something that you do not owe to them.
Also, if the debt is more than 6 years old, they have reached their statue of limitations and they can not persue you for a debt older than that, which they will try to do. Just BEWARE, as there are a lot of nasty people out there - shame on Bally's rep Bernard Humphrey (BJ) for misrepresenting a membership that he didn't sign me up for, shame on Bally's for ignoring my numerous attempts to clear this up and shame on these crooks for trying to scam me out of money, causing me lots of headache and stress, trying to collect money for something I never agreed to in the first place.
I hope no one else has to go through this, but good luck if you do and make sure to answer the court and fight it if you are...
