Jack Miller Subaru Jack Miller Kia, Jack Miller Jeep, Chrysler, Isuzu, Auto Stephen and Michele Welch puchased a extended warranty that was to be fully refunded if not used. When we attempted to get our refund after the warranty period we were told that the owner was the son/ N. Kansas City, Missouri

In 2004 we bought a Forester from Jack Miller Subaru and we refused the extended warranty at first. We were given a document that was signed by the general manager and finance manager that said if we did not use the warranty within the period it was for we would recieve a full refund. When we presented the documant in October 2010 we wre told that the original owner (the new owners father) was no longer the owner and that the document was void. This is classic bait and switch and I would avoid this dealership as they are dis-honest.

Generally, when a business is sold to a new owner, that owner assumes all of the obligations of the business. Think about it. If all contractual obligations made by the original owner were suddenly void after the sale, they could refuse to honor any contracts without penalty. That doesn't happen.
There are some exceptions where the business was sold while in bankruptcy, but if that's not the case, you may have a leg to stand on.
I would suggest taking this to small claims court. You don't need a lawyer and the filing fees are usually small.
