I am an American of color from New York, male, a victim of the U.S. government's fraudulent "War on Terror," in which all Americans are suspected criminals and terrorists.   My government would rather that I not have a passport and no I am not wanted for back taxes or child support or anything else.

 

I contacted Jan H. Brown and he agreed to file a Mandamus action to get the government to renew my U.S. passport so I can return to the United States.  I made it crystal clear to him and indeed, the very first line of his retainer agreement states that the Mandamus is to be drafted AND filed for $2000.  

 

Jan Brown collected his payment, then assigned the case to a 21-22 year old associate who did all the drafting work, but delayed filing until he could get a useless note from the U.S. embassy that attempts to blame me but regardless of its content, rendered the Mandamus filing moot after it had already been drafted.  In hindsight, Jan H. Brown never intended to file it and would only do so with great reluctance.  Lawyers do not like to challenge the U.S. government.  I told him to return my money and he refused, so the credit card charge was reversed.  It should have ended there.

 

But this was not acceptable to Jan H. Brown, so he gathers all my files, 19 pages in all, and sends them to Mastercard Ltd. overseas, with a letter explaining all the details of my case and blaming me, in the hope that Mastercard would adjudicate the matter and pay him, eventhough he did not meet the terms of his retainer.  What wanton disregard for my privacy and welfare, motivated by greed and a lack of compassion for me, his client. 

 

Jan H. Brown charges me $2000, drafts a lawsuit that cant be filed then echoes the note from the embassy to blame me and get paid anyway, hammering another nail into my coffin and leaving me for dead.  With a lawyer like that, you would do better to have your opposing party represent you.

 

If you are considering retaining Jan H. Brown, be advised that he cares only about himself and getting paid.  It's a common problem with many lawyers and this one is no exception.

Writ of Mandamus

This client urged our firm to file a Writ of Mandamus as quickly as possible. A writ of mandamus is an action to compel a govenment agency to take action on a pending matter that is not proceding in a timely fashion. We advised this client that we would need proof of the status of his application for a pasport, which he advised us was never adjudicated. So we rushed to complete all of the pleadings we were to file with the federal court on his behalf. However, before filing we did recieve a letter from the consular official who adjudicated this individual's passport application stating that it had been denied, many months before, as he gave false information on his application and failed to come to their office for an interview.

I then advised the client that, while all of the legal paperwork was completed, we could not file the writ to compel action on an open and pending case, as his case had been closed many months before. We have earned our fee in that we did all but file the writ, which is not possible to do. This client was offered a small refund for the fact that we did not perform the miniserial act of filing the case but he has chosen to demand a full refund instead. It is regretable, but we were paid for services that we did perform.
