Landlord Berates, Harasses 80-year-old 2-War Veteran – Part 1

ST. PETERSBURG, FL – Janet L. Kaspar alias Janet L. Greene, a 49-year-old Landlord-Property Manager for a 6-building – 98 unit apartment complex in downtown St. Petersburg, Florida known as La Vista Investments LLC and Malchut Shlomo LLC, Berated and spoke with a Verbally and Emotionally Abusive tone of voice and body language towards Sam Kolko, an 80-year old Disabled Korean and Vietnam War Veteran because Kolko did not know how to turn-off or reset the electrically wired smoke alarm system in his apartment. Then to add insult to injury, Kaspar left Kolko’s Apartment saying:

“They send you guys to War but you can’t even turn-off a smoke alarm.”

CORRECTION: See CORRECTION at the bottom of this story for JANET GREENE of Boca Raton, FL and Author of GREENE’S RELEASE who is not in any way associated with this story nor should she be confused with Janet L. Kaspar alias Janet L. Greene of St. Petersburg, FL who is the subject of this story.

Not too long after Kaspar Berated Kolko the first time I eyewitnessed that event in horror, Kaspar further Berated and Harassed Kolko again for letting the rear entry door to the building slam too hard which I also eyewitnessed. Kolko says Kaspar has made other harassing comments like this over the 18-months he’s lived there. Kolko, was a Marine Gunner in both Wars and spent 28-years in the Marine Corps Reserves before Retiring.

The specific incidents with Kolko occurred in May of 2011 but I did not inquire with Kolko about the incident or report it for the reasons set forth below in this story. However, I did inquire about the matter with Kolko until I e-mailed about the incidents on August 11th of 2011, and Kolko responded on August 16th 2011, all of which is set forth below in the copy of the pertinent part e-mail correspondences:

From: TERRY RICHARDS To: Sam Kolko Sent: Tuesday, August 16, 2011 10:14 AM Subject: CONFIDENTIAL E-MAIL Also, just to let you know, and even though I never said anything to YOU or JANET, it was very DISTURBING TO ME to hear Janet BERATED and YELL AT YOU in a VERBALLY and EMOTIONALLY ABUSIVE MANNER and TONE OF VOICE, and was VERY DISRESPECTFUL TO YOU that day when you SMOKE ALARM went-off and you did not know how to turn-it-off. It was DISTURBING to me because of the fact that not only should Janet not be talking to Tenants in that manner or tone of voice, but also because you are 80-years old and a Korean and Vietnam Combat Veteran. As you know Janet talks to just about all the Tenants that in that manner and tone of voice. She talked to 58-year old Tenant Ron who lives above you in the same manner and tone of voice as she did you when his fire alarm went off recently.

I do to know if you will recall that we discussed my alarm going off several times every day and in the middle of the night for no reason. You at the time said you had heard it often sitting outside my window. In the thirty years smoke detectors have been invented I had never set one off before and thus had NO experience with how to deal with it. Jan said it was because I needed to open the window, Simply stated I lived down the hall in this building in a smaller room than I am in now that had NO window that could be opened and cooked every day and never had an alarm go off as well as cooking in my second floor room in the big building and never having the problem either. After the incident with Jan the alarm went off 3 times in the middle of the same night. It was obvious to me it was defective as I was in bed and had not even smoked cigarette for hours. I disarmed it rather than suffer her unwillingness to talk or discuss things calmly or rationally.

Jan is hard working and intelligent but has a quick temper that borders on unreasonable behavior when she is annoyed or aggravated.. It is her problem not mine. I am grateful, however. That she is a woman for were she not, although 80. I would have decked her for the disrespect and abuse she laid on me and would have wound up in jail. It was not the first time she talked to me like I was a piece of poop or an idiot and it was just the last straw in my willingness to communicate ANYTHING to her that I think will set her off. Her method of dealing with her tenants does serve her well as most seem to dislike her or fear her. It is a shame as she is an excellent landlord in most respects and has done wonders with these old buildings.

NO ONE is perfect. Least of all me. I hate alibi Ike’s which I would sound like if I pointed out to her that almost every time she has berated me she was wrong because she had jumped to conclusions instead of asking questions that would have led her to the right answer.

Patience and responsibleness are not her long suit and that is a shame

Writer’s Note: Is this the kind of treatment Kolko fought 2-Wars for??? I think not!!! Is this why this Author and other Veterans aside from Kolko Served and Sacrificed and died in Defense of this Nation’s and other Nation’s Freedoms throughout the World to be Berated by Kaspar which has resulted in physical and emotional pain and suffering and mental anguish for me and other Tenants??? I think not!!!

For any Tenants or former Tenants who wish to Write one of the Owners/Principals and/or the Mortgage Company to let them know about how you are being mistreated or how you were being mistreated, and/or to let them know about Substantial Material Non-Compliances like water damage from a structurally damaged Roof or uncontrollable roaches, and that Kaspar unlawfully requires Tenant to be home during repairs, and that their Properties are in jeopardy of permanent damage as wellas potential Personal Injury Lawsuits in the Millions of Dollars, and that we need New Management, the Pinellas County Property Appraiser reveals that the Ownership/Mailing and Mortgage Compnay addresses are as follows:

The Violations of Human Rights and Dignities, Civil rights, Civil Liberties, and of Tenant’s Rights, and the Violations of Housing and Health Codes and Criminal Negligence Misconduct, among other things by Kaspar and whomever the Owners of the Property are, are so prodigious and outrageous, it cannot be told in just one story. Dear Janet,

I do not find the Maintenance Form per se “UNCONSCIONABLE” and/or “ACTING IN BAD FAITH” pursuant to the Landlord Tenant Act and Precedents thereafter, I find the fact that as stated earlier is the “When you will be present for repairs” section of the as “UNCONSCIONABLE” and/or “ACTING IN BAD FAITH” which is not a requirement of the Act as stated earlier.

What I find most disturbing, foolish, insane and silly Janet, is the fact that you have responded to me since last Friday in an “UNCONSCIONABLE” or “ACTING IN BAD FAITH,” as well as a demeaning and “control freak” – its my “way or the highway” manner as also stated earlier, over the repair of an old toilet flapper that was allowing water to leak and that my said notifications to you was beneficial and in the best interest of the Owners whom ever they may be.

For over a year since moving into my apartment I have tolerated and endured or otherwise “turned a blind-eye” to the substantial pain and suffering and mental anguish youhave caused me and others as a result of the disrespectful, nasty and sometimes verbally and emotionally abusive, and sometinesin a criminally verbally and emotionally abusive manner in which you talk to me and the other disabled and elderly Tenants, and the rest of your Tenants as well.

The reasons I tolerated and endured all of the above was because of our former co-worker relationship from 1997-2000, our acquaintanceship, and the fact that I discerned all the pain and suffering you have from the death of your daughter in 2002. PREVIOUS INFORMATION PUBLISHED IN THIS AND THE NEXT PARAGRAPH HAS BEEN INTENTIONALLY DELETED DUE TO BEING ERRONEOUS.

And for the same reasons above, for over a year since moving into my apartment I have tolerated and endured or otherwise “turned a blind-eye” to the fact that you use and order your maintenance men, et al to evict some of your former tenants by having them threaten them with physical harm if they don’t vacate the premises, and also by unlawfully locking them out of their apartments so yu did not have to pay the estimated $900 for each legal eviction.

I also “turned a blind-eye” to the sustantial material non-compliances and code violations, especially the major roof leaks in 442/444/446 – Third Ave North building where the ceilings are caving-in and your having to move at least 3-Tenants to other apartments because of the leaking water rather than spending the money to properly repair the entire roof you only did just a temporary patch job using if even that by using Unlicensed Tenants and Maintenance Men. And you did the same thing ont he 420 – Third Ave North, and 233 – Fifth Ave North Buildings. And by not fully repairingthe major roof leaks at 442/444/446 – Third Ave North you endanger the remainingTen Tenants who live there because that roof could cave-in on them.

I also “turned a blind-eye” to a number of other code substanial Violations but they do not endanger the Tenants.

Because of all of your above and other wrongful actions and omissions Tenants cannot fully enjoy their Residency at Malchut Shlomo LLC d/b/a Lavista Investments LLC, which by the way;

Malchut Shlomo has been Administratively Dissolved and not an Active and Legal Corporaton since September 23, 2006 due to a name change to Lavista Investments on June 01, 2006.

And LaVista Investments has not been an Active Legal Corportation since September 24, 2010 for failing to file an Annual Report. Nor does a Fictious name filed as Malchut Shlomo LLC d/b/a Lavista Investments LLC or without LLC.

Yet, you have filed Evictions in the County Court under Malchut Sholomo LLC and Lavista LLC, and I and other Tenants pay rent made Payable To: MALCHUT SHLOMO and your City of St. Petersburg License is under MALCHUT SHLOMO.

Cara Florida Properties/ Janet Kaspar

As a former tenant for almost 3 years at Cara Florida Properties I can confirm a lot of what has already been said about Janet Kaspar’s attitude and treatment of her tenants.
I have never encountered anyone in any area of my life who talks down to people the way Janet Kaspar does.
She talks down to and treats her tenants like dirt (I cannot stress this enough.) 
The only reason I stayed there as long as I did was because it was very affordable. But when it was no longer affordable I got out of there asap. 
I was not evicted, and I was never more than 2-3 days late on my rent.
I could honestly say I never had a pleasant encounter with Janet in the almost 3 years that I live there. And most of my neighbors (that I knew) in her community felt the same way. We avoided her like the plague.
She had her own building that she lived in behind all the other buildings kind of centralized between most of the other buildings, and the dumpster that all 6 of the buildings shared.
She has a reputation for making snarky/demeaning remarks toward her tenants when they go to and from the dumpster. She also has large dogs back by her apartment that are always barking at her tenants when they try to take the trash out.  
Some of us who lived there referred to taking out the trash as “running the gauntlet” because it got to be such a hassle to do such a simple task.
Janet has a reputation for accusing her tenants of doing drugs, and calling them drug addicts.
She personally accused me of doing drugs on several occasions. And I know of at least 2 other tenants who lived in her buildings who she also accused. She even went as far one time to tell me “she caught me smoking weed, and knew I was the one in the building doing it.”
I was on probation for a DUI at the time and had regular drug test. Not only that but I suffer from extreme anxiety attacks, and have not been able to smoke weed for over 10 years because it triggers anxiety in me.
I was on my way to work the day she confronted me with this. And I was so upset by the time I got to work that I took an early break just so I could call her and straighten things out.
Her exact words were “I caught you” and though I do smoke a vaporizer with nicotine juice sometimes. It had me freaking out thinking she was watching me or peeping on me to use such a bold accusation,  and that perhaps she had seen me smoking my vaporizer or something, and mistook it for drugs.
When I called her from work and asked her what she meant about “she caught me smoking weed” she denied ever saying it, and asked me if I had it on camera.
Moving on to the next major issue I had while living at Cara Florida Properties. When I first moved in I noticed a hole in the roof (about the size of a golf ball) in my shower. Water would also leak out of the hoke when the tenants above me used their shower.
Shortly after I moved in I put in a work order. The maintenance man came out and patched the hole with some puddy. He told me that water was leaking through because the neighbors above me were not tucking in their shower curtain. So he went upstairs and said something to them which led to further encounters with them and me over the issue. They swore they were not leaving the shower curtain out, and I believed them.
The entire ceiling in the bathroom had several seams across the roof where drywall had been replaced and repatched. I was convinced that the pipes were bad.
After they patched the hole it reopened shortly and got bigger.
Over the course of 3 years that I lived there I must have put in at least 5 maintenance requests regarding the hole. On one other occasion, one of her maintenance guys came out and looked at it, and told me that it was the seal for the drain to the tub in the floor above me. That made a lot more sense than the first excuse they said about the shower curtain. But he never fixed it.
By the time I had moved out the hole was about the size of a football, material was constantly falling from it. Materials that fell out of the hole included, drywall dust, chucks of drywall, clumps of caulking/sealant, and even slivers of pressure treated wood like that of a 2x4.
Throughout the remainder of my tenancy at Cara Florida, I’d met at least 2 other neighbors (one in another building) who had had the exact same problem with their roofs. And they were also told that it was from the tenants above them not tucking in the shower curtain.
This shower curtain excuse seems to be a standard excuse they use for what seems to be a very common issue with the piping/plumbing because they are too cheap or lazy to address the real issue.
Next issue I had was with the ac unit. It was leaking water behind the wall, and growing mold. The unit eventually went out and I put in a request. It happened to be during the winter and I was only using it frequently so it was not a big deal.
When the maintenance guy came out to check on the AC he told me that I should have reported the mold issue earlier and that Janet would be mad. I honestly didn’t know there was a mold issue because the “mold” looked like saw dust, and the building was infested with termites (all their building are.)
I put in a second maintenance order concerning the “mold” as he “the maintenance guy” suggested
Janet told me it was not a priority to fix the AC because it was winter and I didn’t need AC.
Come spring when it started to get hot I went into the office and said something to the office manager “Darlene” about the AC, and they replaced it the same day (but did not replace the damaged “moldy” drywall.) I was surprised that they would not do this at the same time since they replaced the unit anyway, and they had made such a fuss about it “the mold” in the past.
I kept my apartment very clean and tidy. When I first moved in the kitchen walls were painted with food, and the apartment had roaches. I was able to get rid of the roaches the first year I lived there, and did a lot of extra cleaning (beyond cleaning up after myself.) Every time I cleaned the kitchen I would work on a new section of the walls to uncover the original paint that had been covered well before I moved in.
I took very good care of my apartment, and was so proud of its state when I moved out. I thought for sure that Janet and the management would be impressed and this was important because I wanted a good referral if I ever needed one in the future.
Boy was I mistaken.
On the day I moved out Janet, the office manager, and the maintenance guy all showed up in my apartment and made it a “big deal/spectacle.”
They complained that the linoleum tiles in the kitchen were bubbling up, and some were lose (this was something that happened over time.) The maintenance man said that it was usually from water damage (I’m assuming the pipes under the sink were probably leaking into the floor since their building had a reputation for leaky pipes and flooding.)
Janet was pissed off and told me I should have reported it earlier. The reason why I had not reported it earlier is because of the almost 3 years I lived there, and at least 10 maintenance request I had put in before. The maintenance issues were rarely addressed, and when so were only done “half way.”
The linoleum tile job in the kitchen was a poor job from the beginning anyway. There had actually been several layers of linoleum tile as I could see the previous layer underneath the existing layer where tiles were coming up. This was a cheap job that they had done which consisted of just “slapping another layer on top of the old one.” And I have no doubt that is exactly what they will do with the next one.
I honestly don’t think that Janet Kaspar is a committed landlord, and I think it is somewhat of an ethical issue that such a nasty person is allowed to run an operation which literally affects the livelihood of her tenants.  
Janet engages in all sorts of oddball activities aside from managing the property she is responsible for.
She tries to run her own coffee stand on the sidewalk by the community. And I have often seen here having yard sale type events up against the fence of the property facing the library. When I observed her and her daughter engaging in this, I noticed a it was a LOT of stuff that looked like it had been taken from evicted apartments. I had also heard rumors that Janet rummages through the property left behind by those she evicts.
This seems kind of unprofessional in my opinion. With a property as large as the one she is supposed to be managing, I think it is in poor judgement for her to invest in these other activities when she is failing as a landlord. I really hope that the propertie's owners are made aware of some of the immoral business practices that take place under their current landlord.
I could write several more pages about other occurrences and issues I had in dealing with Janet, but I have covered in detail most of the major issues.
Be warned: Cara Florida Properties can be a cheap place to live (not sure for how long as the prices seemed to be going up beyond reasonable when I left.)
But you will lose a little piece of your soul for living there.
