As the opposing counsel, Mr. Gelber employs sharp, adversarial tactics and, seemingly, has no concept of peaceful resolution of issues. Mr. Gelber callously disregards the code of conduct and the recommendations of Law Society in dealing with self-represented litigants with registered disability. He makes the litigation process extremely ineffective and needlessly confrontational by agitating the parties against each other, abusing court system by filing frivolous applications and requisitions with the sole purpose to harass and bully the opposing side.

He also enjoys threatening and slandering the opposing party in and out of the courtroom by fabricating and voicing baseless assumptions on record and threatening the opposing party. Over all, Mr. Gelber showed himself to be unnecessarily damaging to the mental health of all the parties, financial standing of his own clients , the resolution of family issues and the possibility of any reconciliation between ex-spouses.

The Legal Process IS Supposed to be Adversarial

AUTHOR: Jim - (United States)

POSTED: Tuesday, January 29, 2019

As the opposing counsel, Mr. Gelber employs sharp, adversarial tactics and, seemingly, has no concept of peaceful resolution of issues.... in dealing with self-represented litigants with registered disability.  I took some of this out because it was way too long, but I'm not sure what you expected as someone who decides to represent himself, but as the saying goes, anyone who represents himself in court has a fool for a client.  It's also important to understand that family lawyers are very aggressive - particularly against people who decide to represent themselves.  You are nothing more than a pigeon in this situation, nor do you have any control.

Your disability also has no relevancy here, nor does it garner sympathy.  What you need is a lawyer to argue your position, not to use your disability as an excuse for anything associated with your case.  If your spouse was interested in a peaceful resolution, then the lawyer would seek a peaceful resolution.  Your spouse isn't interested in a peaceful resolution.

He makes the litigation process extremely ineffective and needlessly confrontational by agitating the parties against each other, abusing court system by filing frivolous applications and requisitions with the sole purpose to harass and bully the opposing side.  If I have a dispute and I need a lawyer to passionately represent me, then I want someone who will fight and argue my position.  What you see as bullying is someone who is representing his client's position with all of the strength they have.  If your spouse truly believed this was a waste of time, then your spouse would discard the lawyer pretty quickly.

Over all, Mr. Gelber showed himself to be unnecessarily damaging to the mental health of all the parties, financial standing of his own clients , the resolution of family issues and the possibility of any reconciliation between ex-spouses. This is a family law situation and you want to reconcile?  You cannot be serious.  In family law, this happens all of the time; one party always wants to reconcile.  Let me clue you in - the other party wishes not to reconcile.  If your spouse were truly interested in reconciliation, then your spouse would come to you and resolve the situation without the lawyer.  If your spouse sends a lawyer, then your spouse isn't interested in reconciliation, no matter what you or your spouse say or think.  Your spouse is interested in winning, not in reconciliation.

In family law, what you see as bullying is your spouse's lawyer passionately fighting for the client.  You see agitation of both parties; what I see is a lawyer fighting for your spouse's position, and you chose not to utilize a lawyer to passionately argue your position.  So you come here to file a complaint for what reason?  To file a complaint because the lawyer is fighting for your spouse's position?  Seriously?  That's what the lawyer is supposed to do  The lawyer isn't there to make sure you reconcile.  You should have filed your complaint against your spouse.

You have 2 choices:  (a) you can hire a lawyer to argue your position with the same passion, or (b) let your spouse win, and then pursue reconciliation.  If I were you, I would choose option (a) because you cannot emotionally handle this process.
