JLROCKEN OVERSTOCK - EBAY SCAMMER, TAKES MONEY AND DOESN'T DELIVER ripoff Seattle Washington

This company, run by an individual named Jim Lakin, sells tapestries and other items on Ebay and Overstock auctions and seems to get a chip on his shoulder when asked about delivery of merchandise. I purchased a tapestry from him in mid-August, my check was cashed on 8/26/05 and two months later, no item. May I add that he charged $14 shipping, which would make one assume that the item would be shipped by a carrier providing tracking information.

Well, time went on and no item. I emailed him several times and responded to his ONE email asking for a shipping address. STILL no package. I finally got fed up and requested a refund. All of a sudden, "it shipped already." Never got it.

I filed a complaint with Overstock and then, unbelievably, he filed a NPB report on ME. I immediately faxed the cancelled check copy to Overstock and they closed his claim. They then asked for proof of shipment and his only response was that he sent me an email stating it shipped on the 13th. Well, that is four different dates he supposedly shipped and it has yet to arrive. He did send me an email stating that I could return it in "resaleable condition" and he would refund my money minus the shipping. I asked him how in the hell could I return something that he never shipped and his response? "You figure it out."

I am not the only one having issues with this person. He fortunately (for him) did not YET leave me a retaliatory negative, as he did other buyers having the same issues with him. He was actually dumb enough to admit in an email to one buyer that he "burned" her.

It is a very minor amount of money, but is now the principle of the thing. Being that it seems as if he has no intention of giving me a refund voluntarily, guess I will have to file in Small Claims. I love Seattle this time of the year. I already have the papers ready to file.
