Kindly be advised that I represent Mr. Zamel Alaqili.

Mr. Alaqili is hereby demanding, pursuant to Florida law, certain amounts from you by reason of your recent transactions with him.

Civil Theft – Theft

This letter is being written under the purview of Florida Statutes, Chapter 772 that provides civil remedies for criminal practices. Section 772.11 requires that before filing a legal action Mr. Alaqili makes written demand you for treble damages. This letter is that demand under the statute. You have thirty days to respond. Your immediate attention is directed to the statute. Our calculation of damages and the treble amount is given below.

We are hereby demanding damages from you as follows for numerous blatant and criminal violations of the following Florida statutes:

Chapter 517, relating to securities transactions: For securities fraud, including, but not limited to false statements, fraudulent non-disclosure, misuse of proceeds of an investment and and other such actions related to his investment in your alleged real estate investment.

Your attention is further directed to Section 772.103:

772.103 Prohibited activities.—It is unlawful for any person:

(1) Who has with criminal intent received any proceeds derived, directly or indirectly, from a pattern of criminal activity or through the collection of an unlawful debt to use or invest, whether directly or indirectly, any part of such proceeds, or the proceeds derived from the investment or use thereof, in the acquisition of any title to, or any right, interest, or equity in, real property or in the establishment or operation of any enterprise.

(2) Through a pattern of criminal activity or through the collection of an unlawful debt, to acquire or maintain, directly or indirectly, any interest in or control of any enterprise or real property.

(3) Employed by, or associated with, any enterprise to conduct or participate, directly or indirectly, in such enterprise through a pattern of criminal activity or the collection of an unlawful debt.

(4) To conspire or endeavor to violate any of the provisions of subsection (1), subsection (2), or subsection (3).

Further, these actions are criminal under Florida Statutes, Chapter 817, relating to fraudulent practices, false pretenses, securities fraud, and fraud generally.

Claim for Statutory Triple Damages

My client has been damaged in the amount of $2,600 in investment funds, $321 in fees incurred with ebay, and $292.35 in funds stolen from his credit card, for a total of $3,213.25 lost by reason of your actions.

At this time, we are therefore by this letter under Section 772 of the Florida Statutes, hereby demanding payment of triple this amount or Nine Thousand, Six Hundred and Thirty Nine Dollars and Seventy Five Cents ($9,639.75) within the required 30 days.

Destruction of Evidence

As you now know that this matter is headed to court, you are warned not to destroy any documents or delete and files, including email, that are in your possession concerning this matter or anything else that might become evidence in this case.

Your attention is directed to Florida Statutes, Section 918.13: Tampering with or fabricating physical evidence.

(1) No person, knowing that a criminal trial or proceeding or an investigation by a duly constituted prosecuting authority, law enforcement agency, grand jury or legislative committee of this state is pending or is about to be instituted, shall:

(a) Alter, destroy, conceal, or remove any record, document, or thing with the purpose to impair its verity or availability in such proceeding or investigation; or

(b) Make, present, or use any record, document, or thing, knowing it to be false.

Any person who violates any provision of this section shall be guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
