About 1.3 years ago, my husband and I bought a home from Chris Hall with Justus properties. He said and I quote "I will treat you like my own daughter!" That shouldve been our first clue.
However, we, my husband and my two kids fell in love with the home and new it was meant for us. Two months after moving in we started to see massive foundation adjustment, that was causing incredible cosmetic damage to our home. What we didnt realize was the damage it had been causing underneath the home as well.
We were told if we had a master plumber come out and do an inspection that we would receive a life time transferrable warranty from MBR foundation. We called the Mr. Hall and he told us to call the foundation company. We did. They came out and told us the part of the home that is being affected was not the part of the home they fixed. With that, the adjuster for MBR said there was nothing they could do and left.
Three months after living in our home we could no longer use the master bath/shower. It wouldnt drain and by then the price to have a plumber come out, was to high for us. So we chose to use the main bath until we could afford another plumber. Oh, by the way, the master plumber we used was referred to us by Chris Hall!!!!
Four months into the house we can no longer open and close doors and windows are cracking! My sons closet doors fell over twice! The front door is so jammed due to the shifting of the foundation, it has to be pulled off and shaved and put back up. The cracks in the brick outside are huge! the cracks in the walls, ceilings .. cracks seperating the marble bathroom counter from the wall by 1.5 inches. My husband could actually put his entire hand under the wall and between the floor in our bedroom and master bath. We have pictures to support all of this.
Next we pull out the sales contract and schematics of the home and realize, the part of the home that is affected, actually IS the part that MBR did "fix!" However, since we have a leak in the slab now due to poor foundation repair, our warranty with MBR is null and void. Imagine that?!
By now it has been six months and we have had at least three foundation companies come in and inspect the home as well as our insurance company (due to it possibly being a safety issue). All three foundation compaines said it would be at least 4k and the last one did a pretty cool test, come to think of it. But they said it would cost 12k. They also said the home was litterally caving in in the middle. Our homeowners insurance said there was nothing they could do as it was not due to anything they would cover. But they did recommend we get a lawyer. The foundation company that came out and quoted us 12k, said we needed a lawyer as well. He said the home should never have legally been on the market with that much damage to it.
Seven months into the home, we are heart broken and desperate as we believe the only thing to do at this point is to walk away and just leave the home. We could not get help from any of the proper channels. and no one would honor their word or warranties. I started asking attornies if they could help, everyone said no. Until I found one that said he would help us on a contingency basis.
This past tuesday we had a water line break. We didnt notice it til we went outside to do our watering and the ground we were stepping on was soggy. In Texas, thats not right. On Friday, I took the day off, my husband, brother and myself started to did. We found the water leak, its in the slab under the house!!!!!!!!!! We call our insurance company. They wont even come out and look because they said the foundation isnt a part of the structure, which is what Im insured for, and they wouldnt fix the problem anyways. they would only replace the carpet or furniture they may be ruined.
My husband just called me and told me our neighbor came out and told him when Chris Hall, the previous owner/realtor, was having the foundation fixed.. The foundation company told him there was a leak in the wall. His comment to them was "Im not paying you to fix the leak, just the foundation!"
So, I ask you this, if we have done everything we know possible through all the proper channels, (I even call our mortgage company and asked them if they could help us) and we cannot get any cooperation or assistance with any of these problems, what would you do? We have to go out to the water meter and turn it on when we shower and clean and then turn it off. Its no longer safe to eat or cook with the water. ?? Our attorney said we have a very good chance at winning the law suit, but that it will take at least 1-3 years and thats only if it doesnt go into appeals court. We will have nothing left by then.
Help, I am overwhelmed and just dont know what else to do.
Why would you sell a home to hard working people who just want to provide for their children and have a safe place to rest their head and one they can call home, when it is in such poor condition you know they will be screwed?
Who is to blame? Chris hall with Justus Realty?, YES! MBR Guaranteed foundation repair? YES!! The present homeowners? Yes! Two of these people are liars and theives and practiced their business illegally. The othe one is a fault for believing they were honest businessman.
