My case was based on lies. All the so called witnesses the state had were coached into what the prosecution believed was happening. Not one of those witnesses were deposed by K.E.L. as I demanded. And not one of those so called state witnesses showed up to my Post Conviction hearing. Although my now friend and the last attorney on the case, Ryan Sulte showed to every hearing and aided in my successful release and Post Conviction Relief. He knew I was wronged and he personally made it right on his own personal time. Not as an officer of K.E.L. Thank You Ryan. If your firm (K.E.L.) is worthy of redemption, I would consider allowing you to file my Governor Clemency to at least clear my name (Pro Bono). Ryan knows how to reach me! I am now good friends with a seated Criminal Judge, a practicing State Attorney, and a few private attorney's if you need references. I will keep Rip Off Report posted of any good faith offers and hopefully a success story.

For about seven years, our firm handled hundreds of cases. The choice to depose certain witnesses and other decisions concerning how a case is handled is basically the decision of the attorney handling the cases.

The choice of going to trial is the client's. Our firm did not charge extra to go to trial. The firing of the attorney mentioned had nothing to do with being a team player. I won't say anymore than that because I have a policy of not attacking people on the internet but the Florida Bar found that his complaint that he wrote after he was fired had no basis.

When we were in the practice of representing people accused of breaking the law, The attorneys who worked for my firm and I went to trial more than most private attorneys. I have a strong belief that the client is the one to make that decision and am sorry that in this case he felt that he couldn't take that chance.

For those who don't know depositions are used to lock down testimony and shed more light on a case. Sometimes they are necessary and sometimes they could hurt your case. There are also times where the information can't be used and don't help to support the case.

I felt bad for all my clients who had to serve anytime incarcerated but it does happen. In this case the client said he took the plea. To avoid the possibility of going to prison for 15 years he accepted five years. He is not alone. The majority of cases are pled out because of the possible penalties you could get if you are found guilty. He might have felt he had to take the plea. I wasn't standing next to him when he made that decision but in the end he chose not to take the risk of being found guilty and having to serve ten more years.

Being a criminal defense attorney has its issues. When you lose or the state has witnesses who are less than candid but may be more convincing than your client, the client is the one who suffers and believe it or not there can be a lot of guilt involved. There were times that I couldn't get a client off whether because they were guilty, the case was really bad or the risk of going to trial was too much. In those cases, you were stuck with it. I do not miss practicing criminal defense and feel for him but these things happen when you practice this type of law.
