I purchased a property off of Ebay from Pac West Corporation on October 21, 2010. It was a 4 plex in almost move in condition, sold free and clear with a warranted deed. Kendal Mason contacted me, sent me a purchase agreement, and wire transfer information.
I wired the funds on October 22, 2010, and was told that settlement would be on the 29th. I waited until November 9th to contact Kendal about the purchase and to request keys to the property with no response. I sent another email on the 17th requesting the same. I finally received an email stating that he was sick for the last two weeks so he just sent the paperwork to be filed. He also included pictures of the deed sent which showed a warranted deed and stated that the property agent would forward the keys. On December 4th I requested the keys again but received no response. On December 13th I received the paperwork back from the city stating that the deed could not be processed and to get an attorney.
I called and left a message. He returned my call and had me send the paperwork back to him. I sent the paperwork back and started to check up on everything about the property through the city. I then requested that he refund my money. I found out that when he sold me the property he didn't even own it yet. I purchased it on October 22, 2010 and the property did not transfer into his name until November 1st. He pushed me off until the deed came in under his name then tried to transfer it.
I had to go to the court house in Cleveland for another issue on February 2nd and I talked to the Mayors assistant. She stated that the sale from Pac West was stopped and they were going after them for house flipping. I then informed her that the property transferred into my name on February 1st. Somehow he got the deed recorded even after it was stopped by the city.
I received a quit claim deed, a property that is uninhabitable, and no way to go after this guy. I filed suit in the local court house and tried to have him served, but the sherriff could not serve the papers since he would not answer the door. I spent the last 2 years trying to find an attorney to work with me on this but no one wants to take on a problem case like this. The city doesn't want to acknowledge the fact that there was an issue with this.
I tried getting information on this man and couldn't get any. I finally gave up, but now I found that I wasn't the only one this guy scammed. Ohio has a major problem with this happening and no one does anything about it. They fix it by going after the buyer not the house flippers.
