We did process the refund and knowing our check was on it's way he proceeded to state to the Merchant Processor: "I called the merchant by phone and emails merchant said they would issue a check for about 500.00 but couldn't say when."

When the email to him is exactly as follows:

Wayne,

Since receipt of this email, DK Enterprises is, effective immediately, firing you as a client. Your email is unprofessional, rude and liable and we will not tolerate this type of communication regardless of your frustration with the situation.

We have separated your hosting account with Network Solutions whom should have already sent you an email to that affect. The designed site is up on the host and available to anyone you want to give the passwords.

We will be processing a pro-rated refund of $500 based on the completed design and the hosting cost($345). This will be sent via check in the next two days. We have put over 100 man hours into working with you and on this site and no longer wish to continue under such circumstances, even if we are losing money on this arrangement.

There will be no further discussion on this matter.


To me this seems pretty straightforward and states that we would and did issue a refund within 2 days. He disputed the full charge and attempted to get the hosting and design for free by stating a lie.

Our email references another email from him that has too many expletives to include here.

He even responded to that email: "How soon can I expect a refund check? Will you please overnight it to me?"

He also fraudulently cashed that check since he had already requested a charge back to the merchant processor. Any reputable person or company would have sent the check back but he cashed it knowing about the charge back.

Mr. Anderton was also the owner of a company that sold The Answer Plan which was removed from the BBB in TN for excessive complaints and unresolved issues.

Just a reminder - BEWARE of doing business with this individual or his various companies.

The comments made in the report are absolutely NOT TRUE and KWA & Assoc. Inc. will be suing for damages and more. We have thrid party confirmation of others that were part of the process of dealing with a Mr. Dave ----, i have never heard or talked to anyone who said there name was Dave Thronton (I am guessing that they are one in the same person but we will have to see) and this may be there way of trying to not be sued for intentionally making false statements. I also notied that the company we had such harriable results with, and we would suggest that NO ONE EVER DO BUSINESS WITH, FROM OUR EXPERIENCE, is DK Enterprises and a Mr. Dave Pettit, not a Dave Thorton which i high guess is an aliass but time will tell as it always does.

Kenneth W. Anderton & Assoc. Inc. is a 30+ year old Corp in good standing with ALL, including goverment agencies. We have NEVER BEEN SUED OR HAD ANY COMPLIANTS OR JUDGEMENTS AGAINST US IN OUR 30+ YEAR HISTORY OF DOING BUSINESS. We have already received written confirmation from the CC issuer that we have been given credit for the funds and misrepresentation, which is what i think has created this false compliant against us. Always follow the money trail and you will find the answer 98% of the time. We entered into an agreement for a Mr. Dave Pettit of DK Enterprises to design a website for us and paid them a half deposit by CC, THANK GOD, and three months later we only had a simple home page completed, that we were aware of or ever told to got to and see, and only after giving the above a drop dead date and pushed the issue to complete the site or else, were we told in an email, not buy phone or letter, that we were supposedly fired. We already had a very high degree of there inability or unwillingness of the above to deliver on the agreed design and this was just a way to not have to admit they could not, or would not, ever be able to complete the site. We immediately DEMANDED A COMPLETE REFUND OF ALL FUNDS PAID TO THEM and they did send us a mimimal $500.00 check. Why would anyone do this if they were not in the wrong and had done everything they said they had done in the ripoff compliant? I have a copy of the check for our lawyers on this point. We then called the CC to attempt to get a credit for the charge and received in writting, this week, the confirmation of such and today we see this sent to us by Google, as a notice of complaint against us.

In closing all i can say is, an old oriential saying says "the who laughs fast does not always have the last laugh". The southern saying is one that comes to mind is; THE GUILTY DOG USUALLY BARKS FIRST! This is the case here and it will be a long drawn out process but check back in a few years and you will see where we filled a lawsuit, assuming we can prove that Dave Pettit and Dave Thorton are one in the same of the firm DK Enterprises in the Denver, Colorado area, the results of time, effort and energy to correct this injustice of the non-truths in this report.
