I purchased a vehicle a 1996 Chevrolet Express 1500 Van. I used my credit card and wrote a check. I was expecting a deposit from both the VA and Social Security. They did not come through. When I realized this I called immediately, trying to work out a solution. Meanwhile, the day after I purchased the vehicle, it broke down. I had it running again and took it to Kerry Ford to speak to Justin, the finance manager. He told me they would be taking the vehicle and keeping it there. We were told to wait until the 'general manager' arrived. A woman came to the table where we were told to wait. She stated that we needed to take the vehicle or 'kerry ford would tow it off at our expense' We took the vehicle home. Within two days the transmission began to slip to the point of only running in second gear. The next day the vehicles engine threw a rod, making it completely inoperable. We spoke to the real General Manager Art Henderickson, he told us that they would not take the vehicle back and they would be 'calling the police.' When I asked if I could work something else or return the vehicle and get back our $1000 Mr. Henderickson said, 'You can go F*** yourself and I'll see you in prison.' I then contacted the owner of Kerry Ford, Doy Baker, we had a discussion and he said that I could return the vehicle and get back our money. I again spoke to Art Henderickson and told him the vehicle had to be towed, due to it being inoperable. A tow truck arrived, hooked the vehicle and began to pull it onto the truck. after about a foot, the transaxle snapped throwing rust everywhere. We were told by the mechanic that if that had happened on the road it could have thrown the wheel off, possibly killing us and our four children. Kerry Ford took receipt of the vehicle and told us if we couldn't be there by 5pm we would have to wait. We called the next day and spoke to Art, Justin and Doy Baker all of whom said that they would be keeping our money due to 'damaged and taxes.' and they said 'they would see me in prison'

Although I can't speak to your specific situation I can tell you the following:

-Arthur Hendrixson the GM has little regard for customers or employees. The fact that he used foul language and threatened you makes me believe most of your story. That's how Art operates.
-The people who "inspect" used vehicles are usually the least qualified mechanics in the dealer. It's a way to get them a few hours when they don't have oil changes. On the other hand certain service writers will give these to mechanics with experience as a reward, we called it gravy, even then what your looking for or inspecting is how many hours you can gouge the Used Car Dept for.
-Doy Baker is not the Owner of Kerry Ford, he is the President, the Owner of Kerry Ford and the Kerry Auto Group is Patrick DeCastro. Baker is however married to one of DeCastro's daughters
-The "managers" like Justin , Joel, or Bev Mills are just figure heads, they aren't actually managers who can do anything for you.

My advice is to stay away. This business hires some of the worst and unqualified individuals to sell cars. Most of them are basically shady, get rich quick type people who will lie through their teeth to get your signature on a deal.  Frequent insults of customers who complain or have a question they can't answer are common as is promising a service or contract will do things that it actually won't were serious problems and still are. I wish I had a tape of some of the things I have heard these people say, it makes a high school football locker room pale in comparison. I know that getting a good deal is great but buying from a dealer with integrity should be high on your list as well. Kerry Ford and it's management team lacks any integrity or business ettiquette.

I stand corrected and thank you for your service to our country.

I stand by my as is means as is but I humbly apologize for assuming that you were on welfare rather than getting VA benefits. But, just like I was wrong in my assumptions, so are you. I do not work for Kerry Ford and, if you were in Afghanistan or Iraq you're quite a bit younger than I am as I would have served in the FIRST Iran war had my eyesight not rendered me unfit for military service when I went to enlist...

Oh and to blow the rest of your assumptions out of the water, I've never played call of duty and I HAVE had sex, with a woman. in fact, my daughter is nearly 21 and I've been married to the same women for nearly 25 years. If I DID chose to play video games though, I'd purchase them myself and play them in the basement of the house that I own...

I'll grant you that Kerry Ford doesn't have a stellar reputation but in this case, they're right and you're wrong. If you wanted to be able to get your money back you should have waited until you received it before spending money you didn't have yet. Lastly, you MAY notice that I've used the correct form of you're and your through out my diatribe and I've used a thesaurus (and a card catalog even) LONG before you could just google everything.

If you mean I should man up by joining the military, going to both Afghanistan and Iraq, spending 13 years of my life before being shot twice and blown up by an IED, before coming home with two Purple Hearts and several other awards for valor... having to be on disability because of a head injury which led to going blind and having to use a special program to 'see' your rant about something you know nothing about whilest collecting a stipend to live off... Please, feel free. After all, if people like me didn't protect people like you and make sure you have free speech while playing 'call of duty' in your mothers basement, where would we be? Probably goosestepping and speaking either Japanese or German. But please make sure to interject your obvious wisdoms upon me, I'll lean back and if i was lucky enough to have my 'government cheese' to eat while listen your witty retorts, I'd make a sandwich. If you need me to loan you a speaking thesaurus to understand my response, I can let you borrow one. For the rest of society, be warned about the dealership you obviously work for or buy all your big boy toys from. When and if you have sex with an actual person and have kids I hope you don't get the next pos that this dealer tells you is in top condition. There are laws against selling dangerous and/ or lemon automobiles, do your research before unloading your next pile on this website.

When you purchase a vehicle AS-IS, that means it is AS-IS.  If it breaks in half, you get both halves with no right to go after the seller (be they a dealership or individual).  Presuming that you are over the age of 18 and of sound mind when you signed the contract, you are an OWNER.

Secondly, just because you didn't get the government hand out that you'd expected doesn't mean that you can get your money back from the seller.  They took your money in good faith and charged your credit card to pay for a vehicle that you wanted at an agreed upon price.  Also the state got their cut in sales taxes.  

I'm sorry that you seem incapable of understanding this but it's pretty cut and dried.  I can almost guarantee you that no where in any of the paperwork you signed did it say that you could get your money back IF the government didn't give you your government cheese.  

Get a job and be a man and "man-up" to your mistake.

"The contract was also void due to the funds provision, whether a loan or cash sale if funds are not or cannot be received, the contract is void."

That's pretty funny...one could just go out and sign a contract and if he doesn't have the funds, it voids the contract...in what world do YOU live?

The warranty is not the issue. You are not allowed to sell vehicles that are dangerous. The contract was also void due to the funds provision, whether a loan or cash sale if funds are not or cannot be received, the contract is void.

was it sold "as-is?"

As-Is would mean YOU pay for all repairs.

If it had a WRITTEN warranty and they aren't honoring it, notify your states commission governing car dealers.
