Arvada Police Report # 98-022653

On 08/27/98 at approximately 0952 hours Officer Guzman Contacted XXXXX by phone in reference to a suspicious incident. XXXXX explained that she is the manager at Executive Tans

located at

inside his room looking over the wall at her. XXXXX told that when the male party had peeped over the wall at her, she was getting undressed. XXXXX said was extremely upset about what happened but didn't know what to do. XXXXX said she told XXXXX that if she needed to press charges, that they needed to know as soon as possible. XXXXX said XXXXX had left, not knowing what to do, however this morning at around 0930 hours XXXXX had called her and said that she wanted to file criminal charges.

PO then obtained information on XXXXX and Kevin Kemper regarding their home addresses as well as phone numbers. XXXXX stated that Kevin had purchased a 3D-day session package and

had begun using their facility on 08/04/98 and ends on 09/05/98. XXXXX mentioned that most of her customers are female and that they have very few male customers.

XXXXX was able to confirm that according to their daily attendance record sheet that Kevin Kemper as well as XXXXX had checked in on 08/26/9B at the same time which was 1210

hours. XXXXX was also able to confirm that in fact, was checked into room #B while Kevin Kemper, the only male party who was at the business during the time, was checked into room #7.

XXXXX describes Kevin Kemper as a white male in his late 20's, approximately 5'6 n to 5'7", 160 pounds with short, sandy blond hair and a goatee XXXXX was not able to provide PO with any further information at this time.

On 08/27/98 at approximately 1010 hours PO contacted XXXXX by phone.  XXXXX stated that yesterday on 08/26/98 at approximately 1210 hours she had gone to the Executive Tans for the first time to use their tanning beds. XXXXX said she believes that the male party who was in the tanning room next to hers was already in his room prior to her going into hers. XXXXX said she remembers seeing the light from the tanning bed coming from the room that the male party was in.  XXXXX said before she had gone into her tanning room, XXXXX was explaining to her how things worked. XXXXX said this conversation took place right in front of her tanning room and that the male party who was in his tanning room would have easily been able to hear what they were saying. Afterward XXXXX had gone into the room to get ready to use the tanning bed. XXXXX described the tanning rooms as all being set up the same. XXXXX said that when you walk into the tanning room on the left side of the room is the tanning bed and in the right corner of the room is a chair. While inside the room, said that she was facing towards the tanning bed and towards the direction of the tanning room where the male party was. XXXXX stated that she was completely undressed when she looked up and noticed that the male party who was in the room next to her had been looking over the wall at her. XXXXX stated by the time she noticed that the male party was looking at her, she had only seen his head bop down behind the wall. XXXXX said she wasn't able to see the suspect's face, only the top of his forehead. XXXXX said the only way that the suspect would have been able to see her was for him to stand on his chair inside his room. XXXXX stated she was alarmed but didn't know what to do so she decided to quickly get into her tanning bed so that he couldn't see her any longer. PO asked XXXXX if she wanted to press criminal charges against the suspect and she said yes.

On 08/27/98 at approximately 1145 hours PO responded to the Executive Tans in order to obtain a copy of the daily attendance record from XXXXX. PO observed the daily attendance record to have the names of K. Kemper and XXXXX signed in on 08/26/98 at 1210 hours. A card number of #8059 was also written on the daily attendance record and belonged to Kevin Kemper.

PO then checked the tanning rooms #7 and #8. It should be noted that there are no other tanning rooms on the other side of room #8. In room #7 and room #8 PO observed both tanning beds to

be positioned on the left side of the wall and chair situated in the right corner of the room. The wall that divides room #7 and #8 is at least between 7' to 7 1/2' tall. PO then had XXXXX stand in the same room that XXXXX had used, room #8, while PO stood on the chair in room #7 Kevin Kemper was using. While PO was standing on the chair, PO was unable to look over the wall . XXXXX was also unable to see PO at all while PO was standing on the chair. When PO stood on the arm of the chair however, PO was able to clearly look over the wall into room #8 at XXXXX. It should be noted that PO is approximately 5'9".

On 08/27/98 PO had left a phone message at Kevin Kemper's residence requesting him to contact PO regarding this investigation. No further information on this date or time. PO will continue to follow-up on this case.

On 08/28/98 at approximately 0912 hours, Officer Guzman responded to Wheat RidgeRegionalCenter in order to contact Kevin Kemper reference this investigation. When PO contacted Kevin, PO explained the investigation to him.

Kevin stated he has been using the tan beds at Executive Tans since the beginning of August, 1998. Kevin explained that he was getting the tan sessions because he was getting ready to go to

Mexico on vacation. Kevin admitted that he was at Executive Tans on 08/26/98 around noon for a tan session. PO asked Kevin if he remembers a female party using one of the tan rooms next to him and he said no. Kevin stated that after his 20-minute tanning session, he had left Executive Tans. Kevin denied ever looking over the wall into the tanning room next to him where the victim, XXXXX was at. PO told Kevin that XXXXX had reported to have seen him looking over the wall at her while she was completely undressed. Kevin replied, "How could anyone do that?" apparently referring to the height of the wall that divides the tanning rooms. PO explained to Kevin that a person could look into the other tan rooms by standing on the arm of the chair that are in each of the rooms. It should be noted that Kevin is approximately 6' tall.

Kevin continued to deny ever looking over the wall at XXXXX. PO asked Kevin why she would be saying that he was looking over the wall at her and he said, "I don't know." Kevin then asked PO, "Could there have been someone else?" PO told Kevin apparently not, that he was the only male party who was at Executive Tans at the time of the alleged incident. Kevin then asked PO, "How could someone just say this without proof?" PO informed Kevin that the victim wanted to press criminal charges and that he was to be issued a summons. PO then issued Kevin a I Jefferson County summons on charges of Third Degree Sexual Assault.

On 08/28/98 at approximately 0945 hours, PO responded back to Executive Tans and contacted XXXXX. XXXXX again confirmed that Kevin Kemper was the only male party who was at Executive Tans on 08/26/98 during the time of the incident. PO then had XXXXX  check her daily attendance record again on 08/26/98 which indicated that there were no other male parties who came into Executive Tans after Kevin Kemper had left. XXXXX stated the last male party who was at Executive Tans prior to Kevin Kemper and t was a "Ken B". According to the daily attendance record, Ken came in sometime between 10:35 and 11:30 a.m. XXXXX said even if Ken would have arrived at 11:30 a.m., he would have easily been able to complete his tanning session within the 20 minutes and been out by noon. It should be further noted that another employee at Executive Tans, XXXXX, stated that she was also working when and Kevin Kemper had their tanning sessions on 08/26/98. XXXXX stated that they were the only two customers who were in their business at the time of the alleged incident. No further information on this date or time.
