K.Hovnanian of Houston II, L.L.C. City Park subdivision deceptive contract cancellation and fraudulent practice to keep earnest money according to Customer Assurance Letter. . Houston Texas

I had been approved for a Loan before going in to K.Hovnanian builders, City Park subdivision, Houston, Texas July 23, 2013.  I also had a HOYO-Home of your own Certificate for the disabled and others of median income level. of which i would be using the City of Houston Downpayment Asst and avenue cdc.org. the certificates or for a yr. and you have to go to another class if need to. My certificate to them of which they said they work with this program; I submitted a copy to him and he told me to bring a 1000.00 cashiers check, that i did and gave to them.  during this time my ccertificate ran from March 2013 to MarcH 2014, iWENT TO ANOTHER CLASS TO UPDATE FOR 2014-2015 SUBMITTED TO Mr. keith AND My lender cdc had been confirmed. the house was not finished of which he had given us  a couple of closing dates; April 18,2014 but they did not meet the closing date, my lender and I were prepared to close but when City OF Houston went out to inspect, the house failed inspection April 2014 they sent a letter saying what they did and would not do as the City had suggested so they would be funded and the deal could be closed, they said in an e-mail that MYlenders would not be able to close, I also was told by my Mortgage consultant, when they inquired about the City coming back, and they (sales consultant} per the builder of K.Hovnanian not for the City inspectors to come back out. They cancelled my contract mind you that the house was not complete or i'd say partially complete in April 2014. My agent and i went for a walk through in april and the fillers for the cabinet the guy came while we were there. and then as the City said there were things that had to be done. they will not give me my earnest money back, and i want it back per Customer Assurance Letter under the heading PRICING,EARNEST & AND LOT AVAILABILITY#2-Plans and specifications may require substantial alteration to meet governmental or other requirements. IF conditions or events occur which cause K.Hovnanianof Houston ii,L.L.C to cancel or cease the purchase of your lot or construction of your home, K.Hovnanian of Houston II,LL.C's sole liabilityand responsibility is a refundof earnest money to purchaser.   They did not meet spec's they failed and then cancelled saying what they would and would not do; yet they work with the City programs, UNBELIEVABLE I NEED MY MONEY. IT is unfair.
