I purchased 2 vehicles from dealer in Oct. 2012, a Ram 1500
and a Chrysler 200.  Purchased both
vehicles in a package deal.  I originally
went in looking for a truck to tow a camper and stated to the salesman( L.
Harris) that it needed to be able to tow 8,000 pounds.  Looked a variety of trucks and settled on a
quad cab ram 1500.   Due to the company
having large rebates on 2012 vehicles my wife and I also purchased a Chrysler
200.  We traded in 2 of our vehicles for
a trade in value of $5,000 each for a total of $10,000, and wrote 2 checks, 1
for $25,000 and 1 for 10,558.50 bring the total cost of the deal, with rebates,
to $45,558.50.

In early Jan. 2013 I discovered that the Ram 1500 will only
tow 6050 pounds, not the 8000 pounds that the salesman said.  This is clearly a case of FRAUD.        
I have tried to work out an agreement with the dealership that I believe is fair.  

I would never have purchased both cars if I had known that I
needed to spend more for a better truck.  

The dealer offered to buy back the the Ram 1500 truck for $19,000, a truck
I paid $23,738 for, a loss of $4,738.

Both the salesman, Leonard Harris, and the owner, Mark Pittman admitted to me in person and on the phone that the #8000 towing on the vehicle was stated by Mr. Harris.

I ask Mr. Harris specifically about the 4.7 vs. the 5.7 Hemi engine.  Mr. Harris stated that the 4.7 engine in the truck would still pull about #8000. 

Now they deny it.  What can I donext?  

I trusted them, paid cash for the cars and later find out that Mr. Harris was mistaken about the towing limit.  I still believe that it was an honest mistake that has now escalated to where we are now.

I have nothing in writing. I had only their word. 

Mr. Pittman did offer to allow me to return both vehicles at a loss of about $7000.00  I was willing to take a loss of $3000.00.

He says I have buyers remorse?  The only remorse that I have is that both the owner and salesman are now denying the details of our conversation, saying I am mistaken.

I am left with no other choice than to seek legal action.

          Mr. Smith says this is a clear case of FRAUD. I disagree. If we had written right on the buyer's order that this truck will tow 8000 pounds , that would be clear. We have no hard evidence like that. I do have this to go on;

1. Mr Smith told me that his trade-in with a 4.3 engine would tow 4900 pounds. I don't think we could have convinced him that buying a much bigger, heavier vehicle with almost the same size engine (4.7) would have been able to tow so much more.

2. I have read that 95% of shoppers research on the internet before buying (like your site). Most, if wanting to tow a big load, would already know what is needed.

3. Our salesperson has been our top salesperson for 10 years and sells about 25 vehicles a month. His current Sales Satisfaction Score (from his customers) is a 95.5 overall and for professionalism he got 100%. It takes 20 PERFECT scores to pull one ZERO (like Mr. Smith gave him) up to a 95.

4. I was not there when Mr. Smith looked at a variety of trucks, but I do know that he accused me of saying things I did not.

5. Mr. Smith said I offered him $19,000 for a truck he paid $23, 738 for. He paid $22,119 after the rebate for the truck. The rest was tax and fees.

       Our salesperson said they did discuss towing but never did he say this truck is rated to tow 8000 pounds and I believe him. I tried to make a special deal and give Mr. Smith the benefit of a doubt and take both vehicles back. I charged him some, as he did have the use of two vehicles for 3 months, that is worth something.  He wasn't interested as he said he could radically beat my deal at another dealer. I am sorry we could not end this better. If Mr. Smith is positive about his accusations, I do not blame him. I don't believe him and I believe with all the dealers he visitted and all the trucks he looked at, he is mistaken.
