Kivah Harris Elayna White Model Management Firm, Havik Enterprises LLC, STRUT, etc. etc. SCAM ARTIST Tempe, Arizona

My story:
Ms. Kivah Harris signed me with her agency in August of 2009. I paid $175 up front which I was told was going to to toward my portfolio/compcards/business cards etc. After several "paid gigs" fell through, including a trip to Aspen, I started looking around for the contact info for the corporate offices we were told were located around the country. The only addresses or phone numbers I found either didn't exist or went straight to the office located in Tempe. I started asking questions and when I did I was told that I was being let out of my contract. I asked for my money back and was told that my portfolio had already been mailed out. This was about 4 months ago. I emailed Ms. Harris last week demanding my money back or I would be taking her to small claims court. Her response was to first try to accuse me of slander/defamation of character (see below) and then said "I will see you in court." I started asking around to other people that were either signed with the agency or were working with Ms. Harris to see if they had similar experiences. Every model signed did. As for the employees, they no longer worked there because she wasn't paying them. Because of this other models started emailing demanding their money back as well. A few days later Ms. Harris sent out an email stating that she was resigning from her position and closing the "Tempe branch" but that she was sending everything to the "corporate office" for litigation and that we would all be receiving either our portfolios or money back within 90 days. As I stated before, I have yet to find a corporate office. I suggested that people email asking for the contact info so that they could keep track of what is going on with their cases. Ms. Harris has so far refused to give out that information because she doesn't want anyone "bothering the other offices." RIIIIGGGGGHTTTT.

It has recently come to my attention that I am not the only person who feels cheated by this agency. If you feel, as I have, that you have been scammed by Ms. Kivah Harris/The Elayna White Model Management Firm/Havik Enterprises LLC/STRUT etc., please take the time to file a complaint with the Better Business Bureau. It only takes a minute and doing so will help ensure that we all get our money back/money that she owes or that legal action will be taken towards that goal. The firm is not listed in the directory so you will need to fill in all of the information yourself (name, address, phone number etc.). If you need any of that information please let me know and I will give it all to you (I go off of the information listed by the Arizona Corporation Commission).

I have also filed a civil complaint and plan to take Ms. Harris to court. If you are interested in being a part of this, please let me know.

It has also recently come to my attention that Ms. Harris sent out an email resigning from the firm and shutting it down after getting complain after complaint about people not getting what they paid for or owing her money. She claims that she is turning things over to litigation with the corporate office, but to this day I have yet to find a phone number or address for any office other than the phoenix one. If I were you I would ask some serious questions. Most importantly, ask for the contact info for the supposed "corporate office" because in my opinion it seems like she is hoping that by writing that people will believe her and give up trying to get their money back.

*I should note that it is strictly my OPINION that this agency is a scam, and I am not claiming that it is a fact.

If Ms. Harris or any person has tried to accuse you of slander/libel/defamation of character etc., as she has with me, do not worry. Know your rights!

Defamation is the difference between fact and opinion. Statements made as "facts" are frequently actionable defamation. Statements of opinion or pure opinion are not actionable. In order to win damages in a libel case, the plaintiff must first show that the statements were "statements of fact or mixed statements of opinion and fact" and second that these statements were false.

In order to win (or even file) a case she would first have to prove that it was not just your opinion and she would have to prove that the statements you make are false... which something tells me she would probably have a very hard time doing. In my opinion, it seems like she wants you to be too afraid to do anything about it. Stand up for yourselves, and make sure anything you say or write is CLEARLY stated as your OPINION.

As for any threats to your well being, please DOCUMENT these occurrences... even if its just by writing down the date and time.
