I let Krista Nicoles age 24, move in to a Room in my Basement a week early on Good Faith to pay Rent and Deposit on July 1st 2010. The First Came and went with no $??? Many Excuses and Delays. She Moved in her Daughter for three weeks on a two week Visitation access?

Gave Her Rides to Run errands in town as she has no car, Shared Meals and food with her. Not included with shared Kitchen Roommate, Invited her into Living room to watch TV many times to watch TV and rented movies.

Negligent Mother allowing her 4 year old daughter to play on Basement stairs-Kid broke her arm. She blamed me for being at fault for no handrail that she refused to have put in when taking Room. Threatening to file a complaint or to sue. I was Shocked. I offer to put it up immediately.

Numerous Harassing Letters-Daily! Constantly Uttering threats of filing complaints-Court Action, Tenancy Branch, Law suits etc. Arguing semantics constantly. Insisting shes a Tenant covered by Landlord Tenants of Alberta and not a room mate.

July 15th still owing $, I wrote her a letter requesting rest of $ and please pay next months rent by end of month, Refused to talk to me Screaming shell move out at month end. 

July 16th arriving home I told her we needed to talk, Screaming she refused, threatening me again. I called Police to attend. Constable Trombly and another Constable Attended. Police surprised I was giving her till month end to pay and hadnt given her a 14 Notice for non payment on July 1st, Police asked if I wanted her removed and I said yes, They highly suggested I give her a 14 Day notice for Non-Payment Today as it was the 15th.

she told Police shed go stay with her Boy Friend and wanted me to watch her dog and cat till month end, I agreed and she left with boy friend, later that night she returned at 11pm and stayed night anyway, (recanted the next day by officer Trombly)

July 16th -The next morning leaving another hate mail stating her (late) notice superseded my 14 Day notice to vacate for non payment on July 29th, that I should check with Tenancy Branch, etc.

I decided to take her advise and called the Landlords Tenants Branch with the Alberta Government, I identified myself and described situation, They Insisted that she is not covered by the Landlords Tenants Act since we share a common Kitchen and Bathroom, That it is a Domestic / Room mate Situation, That the thing that would apply is our original mutually signed Agreement and or Court action, a civil mater.

 

I then Changed Locks and wrote her a note stating she no longer lives here and to contact the police to make arrangements to come get her stuff as I do not want to here any longer due to not feeling safe due to all her Harassment, Abuse, Uttering Threats etc.

 

She Came home at 4pm to find note taped to outer side door and Lock changed. She called police and they called me. I explained to same Constable Trembly from yesterday. He was demanding I let her stay another two weeks. I reminded him that he had recommended yesterday that I call Landlords Tenancy Branch as they didnt know either if she was covered by Act or Roommate? He was surprised and insisted I allow her to stay another two weeks, I refused.

 

I asked if I could get a Peace Bond or with straining Order against her as I feared for my safety that with all here threats shed either attack me or lie and say I had attacked her. That the Domestic relationship (Non-Sexual) had degraded beyond rectifying. He said no Id have to go to court to get one.

 

He insisted I allow her to say another two weeks. I refused. He threatened to have me Fined by By-law Enforcement for having an Illegal Sub Tenant Renting, I Refused. He threatened to Contact the Owner and notify them. I refused.

He Passed the Phone to another Constable, Constable Jaworski, With same concerns and was going to have me fined by Bi-law Enforcement, etc. then suddenly apparently they had misunderstood, I Told him that she was welcome to come get her stuff at any time. I just did not want her living here any longer due to Her Abuse etc. Then he agreed with me and said maybe I could give her a small prorated amount of rent back for not being allowed to stay the rest of the month. I agreed and he passed the phone off to the first constable again.

 

Constable Trombly spoke to me again, and was insistent that I give her half the rent back rite now today, threatening to have me fined and police were on there way over now and they would go all the way with it. That shed stay for another two weeks. I told him I didnt have the money, I could get it from my employer that was out of town, on Tuesday. This was not acceptable to him and he wanted an answer now, told him I could ask my neighbor for a loan for the $225.00 that was agreed to by her and him. I told him Id have to check with neighbor to see if I could borrow money. He ended the conversation saying he was on his way over to make sure she moved back in.

 

I had my 15 year old son that lives with me here go and ask the neighbor Lady if I could borrow the money as Id lost her number. He returned with her number, I called her and asked to borrow the money. She said yes. And had my son go get it from her in an envelope.

 

I spent several minutes trying to reach the Constable thru the switch board. To no avail.

 

I went out to Krista waiting in her boy friends truck and told her I had the money the police had said she wanted. She refused saying she wanted half the Rent and Deposit too. I refused and returned to the house and reached the Constable thru the complaint line as the main switchboard had closed at 4:30 and it was now 4:40pm. I told him Id gotten the money and had gone and told her but she was now refusing and wanting more money. He agreed that the deposit is customary to be returned 30 Days after a tenant moves out. That hed talk to her and get back to me.

 

He called back and said he talked to her and shed accept the money I had and would move her stuff out. While talking to him, Krista came to the Door saying shed talked to him, I had already made up a Receipt for her to sign stating shed received half the rent and would get the remaining deposit after 30 Days, She started to sign, then stopped and refused, wanting the deposit now. I refused and told her its customary to get it 30 Days after moving out. I suggested 15 Days and she accepted and signed as the Officer walked up the sidewalk asking if all was well. She said yes and confirmed that shed get her animals and few things now, Id open side door and allow access to the Basement. That shed return Saturday and Sunday to get rest of her stuff out.

 

She got her animals and a truckload, told me she was done for today and would return tomorrow at 10am to remove more stuff and on Sunday.

 

For now the nightmare is over, Humiliated that all my neighbors saw police here wondering what was going on? etc, all to accommodate a Drama Queen. Nice to know the law there for me with a peace bond when I needed one, Not! Yet there to do it if youre a chick, been there done that. Whatever, par for the course. What else is new. No Good Deed goes unpunished.
