My car was stolen right here in Phoenix 6 months ago. I was never contacted until now and kwiky towing wants $4,000 in storage fees before I get my car back. It turns out the car was towed 3 days after it was stolen. The tow yard never reported my car to the police when they towed it. I could have had my car back 3 days after theft but I was called 6 months later.
They keep the cars without telling anyone and then after a certain period of time they get abandoned title and keep the car. This is an obvious ripoff. My phone number not only never changed, but I continually checked on the case by calling the police to see if they found my car. They said every time that they did not.
The only reason I was called was because an officer was doing random checks in the tow yard and my car came up stolen. The officer casually stated that I could pick up my car, and the towyard manager casually stated that I could as soon as I paid the $4000 tab. The manager also added that only 1 month remained before he would legally take ownership of my car.
It's as if he was explaining his plan to me, because maybe there is nothing I can do.

Illegal Practices of Tow Companies

In the future, if you car is ever considered a "private tow" (meaning a private party had it towed, such as from a apartment cmplx, busn, etc) and not a "police-initiated tow" (meaning the police dept had it towed) then you are entitled to get your car from the tow company, as long as you have the documentation required to show proof of ownership. They can not hold your car for storage fees.
They can, however , bill you later for the charges, which you can fight with them in small claims court if you feel the charges are not justified and there is a monetary limit they can charge. This was put into effect due to a lot of problems with "shady" tow companies (not all, but some).
If you attempt to pick up your car w/all the proper paperwork, it was a private party-initiated tow, and they still refuse because of lack of payment, tell them you are calling the police. Usually they will change their tune... if they know the law!!
