I signed a 3-year contract with Lady of America in Coral Springs, Florida. At the time I signed this contract, I notified the manager who signed me up that I would be moving to Arizona in a few months. He assured me that there were Lady of America clubs in both Phoenix and nearby Scottsdale; and that I could transfer my membership. I also looked up Lady of America's website, and confirmed that indeed there were clubs where I would be moving.
However, when I moved I found that the 2 gyms nearest to me had both closed down. Their phone numbers are disconnected. I called the 800 # customer service, who were not aware that these clubs had closed, and they were not helpful at all. They sent me to a Ladies Workout Express, which is completely different from the gym at which I signed up. The gym I registered at had many classes, cardio machines, weights, etc... The Ladies Workout Express is very tiney, it has no classes, no cardio machines, and very few weights. The concept is entirely different, as it is set up for a 30-minute circuit training course, and that is all.
However, nobody in customer service seemed to understand that the two gyms, although they may be affiliated, are completely different in their concept and services.
Because I was assured that I would be able to transfer my membership to an equivalent center, I do not feel that I should be forced to pay for a gym that is completely useless to me. It even states on the back of my contract that if my gym closes, they have to provide an equivalent center within 5 miles. They have failed to do so. However, because I moved from my original location, the company is trying to force me to continue making payments because their "affiliates" are within a 25 mile range of my new address. I believe I should have been made aware of the huge difference between these two centers. I never would have signed up for 3 years if I knew that they would try to force me to pay for a gym that is underequipped and has virtually no services. This is an unfair business practice.

Lady of America are liars and never to be trusted

Lady of America is by far the WORSE company I have ever known. Their representatives are trained to lie and con you into signing a contrat. I joined this so called gym simply bacause according to the reprensative it was a month to month and that I could cancel or freeze my account with a 30 day notice. Since I had come from a gym that actually honored their month to month contract, I believe this rep at LOA and signed. However, due to economic situations I had to move and when I tried to cancel my month to month I was in for a big unpleasant surprise! Turns out I the contract I signed was NOT a month to month but simply a 36month contract term. You can imagine the frustration and anger I felt at that moment. I have been tricked & conned into signing a contract by this unethical pathetic representative from Lady of America. And ever since I have been fighting the never ending battle with National Fitness whom finish screwing the customer. I have not paid the gym in three months because of my financial situation at the moment and also because I was straight up taken advantage off from these jerks. I have sent National Fitness NUMEROUS of letters disputing my supposed contract and I've asked them to cancel my contract and they told me to sent proof of my new address in which I have but yet they wont cooperate with me. And now I'm being harrased by a third collection agency on their behalf, they are threating me to take me to court and garnish my bank account. Well you know what, I don't have the money and even if I did I don't believe I should pay these con-artists a single penny!
And YES it is very true! Lady of America stays in business by tricking people into signing contracts. They tell you everything you want hear and call you every single day but once they get you to take the bait they trap you and they do not care about you or your rights at all.
I am doing my research and I will find a way out. In the meantime I will file a complaint with the better business bureau and inform as many people as I can to stay the heck away from Lady of america or sister companies.

Do not simply take yourself off of auto withdrawal...that will just make them put you in collections when you don't pay and then you will have a judgement against you!
Why cut off your nose to spite your face? That's ridiculous advice from a likely deadbeat who doesn't care about their credit.
I say, unfortunately, live and learn. Take the lumps and move on...because you're never getting your money back. Those contracts are airtight.

National Fit Check is the collection agency for Ladies Workout Express. The owners of LWE have extensive problems with the company as well. This is one time that there truley is 2 sides to the story. Our drafts are always wrong, we are debited for monies and given no explanation...really. But because we signed an agreement, an agreement that WE HAD NO CHOICE IN,Our parent Company LAdy Of America forces us to use, we have no recourse.
I have to deal with then constantly! Im sorry, but as an owner our hands are tied more than the consumer will ever know!

#3 Consumer Suggestion
Easy way to fix this

I visited a Ladies Workout Express and really liked it. I purchased a ten dollars for ten days deal. I was ready to join. Then I looked at the contract. It was awful, very one sided. It is a third party contract with the payee in Utah and the contract has all sorts of things that benefit the business, not the consumer. The worst was that any dispute was to be decided in Utah jurisdiction - that makes it difficult to go to small claims or sue locally and I'm sure the company knows that they will win in Utah.
I showed the contract to my husband who has a legal background and he said no. When I questioned the staff member about the contract, she said it was a matter of trusting Jeanie, the owner!!!!????? For one, the contract is not with her, two, if there is so much trust, why a 3 page contract?
All you need to do is cancel the direct withdrawal with your bank. If that isn't good enough, cancel your credit card and change it, or change your bank account. They can't bill you anymore - let them try to sue you for the balance. I would report the third party that they sell the contracts to, they are part of this scam. Contact your credit card company to reverse the charges. Not only will you get your money back, if they get several complaints it will be a problem for the business.

IN RESPONSE TO JOY:
First of all, I did NOT sign up at LWE. I only signed ONE contract ONE time (in Florida at Lady of America). I only went to LWE in Phoenix to check it out, thinking that I would sign up, as I thought it would be relatively similar. However, as soon as I stepped foot inside the gym, which is smaller than my living room, I realized that obviously it was not the same. Therefore, I did NOT sign another contract.
I am glad that YOU like LWE (although since you are an owner you must admit this is a little biased) but I wanted a full size gym (which is what I signed up for in the first place)
I wanted to make this clear, since apparently you did not understand. I am not blaming others for my mistakes; unless my "mistake" was to assume that LOA/LWE would honor their contract cancellation clause and act fairly.

After carefully reviewing your complaint, I find that you did have the option to cancel your membership which you did and then you went into a Ladies Workout Express and signed up again.
As an owner of a Ladies Workout Express, I've never forced a person to sign up. All potential members have the opportunity to tour the club, check out our program and make a decision to join a 12 month, 24 month or 36 month membership/program. It's the members choice.
It sounds to me like you made the choice, signed the new agreement and then decided it wasn't for you after the fact. This should be a lesson for you to think before you buy as we are all trained at LWE to educate potential members and give them information and offer a value added service. I think that your accusations are off base and you need to look at the decision you made. We don't twist arms here.
On another note...the workout express center is awesome. Where else can you work out in half the time with greater results than at the traditional gym? With women who become great friends. Yes it may be smaller in size but have you heard lately that the 30 minute express workout is the hottest thing since sliced bread? Burning Fat and building lean tissue muscle 4 times faster than any other program. Oh and did I mention the personal training you get which is included in your membership. Last time I checked it cost $40 to $60 an hour to get the advice you get from the Ladies Workout Express Centers.
Without being to hard on you, since you have a membership that you are stuck with because of your own doing, I would suggest that you use the club and get the benefits from the small amount of money you are paying and stop blaming others for the mistakes that you make.
