Nuway Venture LLC, Lamon Holloway, Pacific West Equity & Financial and Investment Group (PWEF), Robin R Thompson, Don Hayes, Susan Montgomery, and Barons Investment & Trust, are doing business as a Mortgage Broker / Lender at 600 Anton Blvd., Suite 1100, Costa Mesa, CA 92626 and 670 Rolling Green Dr., Las Vegas, NV 89169 and 300 Park Ave., Suite 1700, New York, NY 10022.
That on or about January 13, 2009 Thompson, Holloway, Hayes, Montgomery, through their companies mentioned above, seduced me to pay $35,000.00 in order to be able to obtain a Commitment Letter. On January 14, 2009 I delivered to said individuals and their companies a signed Letter of Interest citing an obligation for $36,517,500.00 to Pacific West Equity & Financial and Investment Group.
In fact, the letter was delivered to and accepted by them, even though (a) they knew that they did not previously deliver consideration of the deposit paid, and (b) that they had no plan, and no intent to ever deliver more. Instead, they sought keeping the $35,000.00 deposit.
Nevertheless, to seduce me into paying the $35,000.00 at once, they committed Corporate and Mortgage Fraud by (1) Falsification of financial information, including false accounting entries, issuing bogus letter of Proof Of Funds from BARONS INVESTMENT & TRUST signed by Susan Montgomery, designed to inflate profit, and false transactions designed to evade regulatory oversight, (2) Self-dealing by corporate insiders, including: (a) Insider Trading, (b) Kickbacks, and (c) Misuse of corporate property for personal gain.
On numerous occasions I requested from these companies mentioned above to supply me with a list of the documents they would need for the closing. Please keep in mind that, when they sent me the agreement for the loan amount, the only thing they asked for was the name of my company and nothing more. The individuals mentioned above set the closing date for February 6th, 2009. Then they requested it to be changed until February 13th. Then once again they requested it to be changed until February 23rd. Finally, they set the final closing date on March 6th, 2009.
On February 15th Mr. Thompson sent me an email, and I quote, Mohamed, here is the list of items that we need. If you do not have them or feel that they do not apply, please explain in detail and I will see what I can do. I have performed all conditions precedent required of me and sent over all the required documents forthwith.
On February 23rd they responded with an email Mohamed, Thank you, I have received your documents. I am actually speaking directly with the investor about this today and will see how fast we can get this completed.
On March 2, 2009 the individuals mentioned above informed me that there would not be a closing and there is no money to fund the loan.
On March 5th Thompson emailed, and I quote, I REALLY DON'T KNOW AT THIS TIME. WE MAY HAVE SOMEONE TOMORROW OR 5 YEARS DOWN THE ROAD. AT THIS TIME I AM CONSIDERING CANCELING THE WHOLE THING.
Numerous demands were made to fully refund the deposit, from March 3, 2009 through and including today's date, as is established by numerous emails. In addition, despite these numerous demands, these companies, through their owners and agents, refused to REFUND my upfront fee deposit.
During the course of approximately three (3) months, they fraudulently induced me to pay in excess of $35,000.00 by falsely stating and representing that prior to issuing a Commitment Letter, I must pay this amount and that these monies would be listed as a credit on the closing statement.
These individuals and their companies knew that the statements were false because they never intended to give credit, as represented to me. These individuals and their companies knew that the statements were false because they never issued a Commitment Letter, as represented to me.
That they knew full well that I was relying on their representations to obtain a loan and that the loan would be funded. Thompson, Holloway, Hayes, and Montgomery intended for me to rely on their false statements and representations.
That the actions of these individuals were intentionally fraudulent and deceitful in order for them to manipulate and steal my money for their own personal use. After hiring a private investor to check out these individuals, I came to find out that my $35,000.00 went toward a new 2009 Mercedes S550, which everybody shares. I have reported these individuals and their companies to every regulatory agency in the USA. I WILL NOT REST UNTIL THEY REFUND MY DEPOSIT. IF THEY DO NOT DO IT VOLUNTARILY, I WILL DO IT FOR THEM. Please do not work with these scammers. They will steal your money and they will never fund your loan. I will keep everyone updated.
