Hello I was mislead by the bank about a check that supposably cleared.  Well it didn't and the check was over 3000 dollars   There own people in collections said there was a screw up and the check should have been held for 7 days.  Well i started an investigation about this frauduent check.  I asked for time to see if I could recover.  Now I had been communicating regularly with the branch manager at Hilltop  I find out the investigation can do no more March the 28th.  I inform the bank Im working on how to get the money.  I contact the manager and say Ill have it in 10-15 days.  Never communicated to the collections etc what I was doing or the investigator  Because I pay bill on the 21 of Aprill on the 22 I get a summits to go to court on June 14    why file a court order if there is a ongoing investigation  I had one and the bank as one ongoing.  Poor commuications from manager to the rest of crew as to what is going on.  I stayed in constant communications with them.  they never sent me a bill as to what was owed or that i would be going to court if I didn't pay.

This must by why Credit Unions have lower fees. When someone comits fraud against them they don't fool around. They go right to the courts.

Oh you say you didn't commit fraud...sorry wrong answer. Yes, when you deposited the fraudlent check you yourself is the one who is part of this fraud and due to various legal concepts, such as the concept of being a "holder on due course" you are responsible for paying back the bank if it is fraudlent.

Let me take a guess here. You got a check(somehow) from someone you don't know. Now, this person for some reason requested that you cash the check and send them a good portion of the money back in the form of Gift Cards/Money Grams/Western Union or Money Orders. Now this could be for reasons such as being a "Seceret Shopper" or perhaps some other sort of job such as sending/receiving packages. Perhaps even the "key" scam where you were trying to get an apartment. But the fact is that this is a well known scam and the default positon falls back on the person that they should have known something was up.

Now, you say..but this person told me to wait until it "clears". Yes they did because they know there are laws and regulations that require a bank to release the funds before it may actually have cleared the bank. Where in this time you "think" it is okay only to be hit later with the fact that it is a fraudulent check.

Now, as a suggestion I would immediatly contact an attoney because if you have a summons they are very serious about
collecting, and the chances of a judge buying your story that the bank is the cause of all of this is about zero. If you get out of this with the judge arranging some sort of payment plan instead of something more drastic consider yourself very lucky. Sorry not trying to beat you down..just giving you the reality of your situation.  If it sounds too good to be true..it probably is.
