I recieved a call today from a California number on the caller ID, area code (909) when I answered they asked for me but since I don't talk to people I don't know I said I wasn't home and asked for them to leave a message. The guy seemed nice, said he was calling from the Law Office of Sidney Mickell in California (he repeated that he was in a law office in California several times through out the call) and said it was concerning a private matter that I probably wasn't even aware of, asked me if I owned the property I lived at (at the time he wasn't aware he was talking to me).

I took the toll free number that he gave me down and said I would return his call. I searched the internet first for information on these people and found multiple sites with complaints about them. On BBB.org there are two Law offices of Sidney Mickell listed but the address that matched the number was to the one that had a big old "F" grade. Armed with this information I called the company back.

I talked to a Michael first who was very nice and said I had a debt of $1,500 and some odd change for a purchase I had made. And he's right, I do. Its a long story behind that but I agreed it was my debt and that I wanted to pay it back. I asked if I was able to make payments and we came to an agreement of $70 a month. Then came the problem. He wanted my bank account information over the telephone to set up a debit withdraw each month from my back.

After I explained to him that I wasn't comfortable giving that information out over the phone and that I would need for him to send me a written agreement of the terms of the repayment and that I would then set up a debit withdraw from the bank account after having the written agreement he put me on the phone with someone else. This new guy was completely rude.

He said that he was going to push my paperwork through and put a judgment on me for the total amount if I didn't give them my bank account information. What do I do now? I want to make good on my debt. I want to repay but I am not going to blindly give my account information to this company either and they won't except anything else!

And as a side note I found on this website through a search of the companies address another complaint only under a different law firm name, are they the same company?

You gave no information regarding the debt - but most have a statute of limitations and this debt is probably too old to legally collect.

I had a Collection agency call me once about a debt of my son's. He also claimed to be an attorney and claimed my son had put my name on the account. This was a lie - the entire call with him was a lie.

I wrote formal complaints to the CA Attorney General, and the head honchos at the debt collectors - he was fired for mis-representation. What I did not know at the time was we could have sued the Collection Agency for this violation of Federal Laws.

NEVER ACKNOWLEDGE A DEBT WITH A COLLECTION AGENCY - even if it is valid
They are required by law to prove the debt is yours. They cannot call and just demand payment from you. They are also required by law to send it writing first. When they do as you described its illegal.


never negotiate a payment over the phone - it has to be in writing. YOU DID THE RIGHT THING NOT GIVING ACCOUNT NUMBERS.
THEY WILL TAKE MORE MONEY FROM YOU THEN AGREED UPON WHENEVER THEY FEEL LIKE IT AND CONTINUE TAKING MONEY AFTER THE DEBT IS PAID

And they cannot add fees or interest on it - and they will try to do so.

Collection agencies cannot be trusted.

Please Keep In Mind That A Legitimate Law Office Would Not Be Giving You An 866-800 Or Any Other Toll Free Number To Call Them Back It's A Scare Tactic Regarding The Attorney Name It's Probably Real The Pay Him A Fee Every Month So They Can Use It In All Accuality They RENT IT So They Sound's Pretty Scary Plus He Can't File Suit Again'st You He's In California I Bet If You Had To Mail Them Payment You Would Get a P.O Box Number I Understand That You Want To Pay In Good Faith But Make The An Offer Of 50% Of There Asking Thats Call Good Faith Bargaing BOTTOM LINE THERE TAKING ADVANTAGE OFF YOU THERE SCUM THEY PROFIT ON THIS AND TAKING BET'S IN THE OFFICE TO SEE HOW MUCH THEY CAN GET YOU FOR I KNOW USE TO BE A COLLECTION'S MANAGER THE MORE THE GET FROM YOU THE HIGHER THE COMMISSION IS I TELLING IF YOU BREAK DOWN CRY PLEAD AND SO ON ONCE YOU HANG UP THE PHONE THERE LAUGHING THERE HEADS OFF AND HIGH FIVING EACH OTHER AND SAYING WE GOT HER DON'T GIVE IN.
