on Dec 7, 2006 a Madeline Castillo called my employer and asked to speak to Human resources. She then demanded to be transfered to my extension, or she would "start garnishing my pay by Dec 8". When she reached me, she stated that I ahd to call their number and speak to a Ms. Diggs at ext 1755, that afternoon or they would "garnish my pay starting Dec 8".
I called and was transfered 4 times, then spoke to a Ron Alexander, who kept trying to get me to agree to a debt. I told him no, not without validation. He then said" Well I am just going to send you a letter stating the amount and the originator of the debt, if you get that do you agree to pay". I stated that the debt had to be validated, then Ron stated that if I did not agree, they would "start proceedings against me", confirming that they had no court order for garnishment. I hung up.
This company has been faxed a cease and desist/demand for validation. The company they claim originated the debt has been provided proof that they call multiple times in a day, violating FDCPA, and the instancce. They have been reported to the FTC, and the AZ state attorney general.

Scott,
They engaged in multiple violations of the FDCPA.
When they called your employer and stated they would garnish your wages, they violated the FDCPA. Get a statement from the person who took the call, and file a lawsuit immediately. It is easy money!
FYI..There is no such thing as a "cease and desist", as per the exact verbage of the FDCPA it is a CEASE COMMUNICATIONS request.
And, faxing is not proof that will hold up in court as to what you sent and who recieved it.
Everything should be sent by certified mail, return reciept requested, and always put the certified# on the letter itself and make a copy for your records. This proves WHAT you sent and WHO recieved it. Makes a lawsuit a slam dunk.
File a separate complaint online at ftc.gov for each violation.
